Pirate Bay goes on the lam, heads for safe harbor in Spain, Norway

Despite a recent effort to move its servers to the cloud, Pirate Bay will be moving its base out of Sweden thanks to recent legal pressure. The Swedish Pirate Party that hosted the torrent site has been feeling heat from the film and music industry-backed Swedish Rights Alliance, which gave it until today to cut ties in order to avoid a lawsuit. As a result, the site has moved its operations to servers in Spain and Norway hosted by Pirate Parties there, saying it's had a contingency plan in place for awhile to do so. Anway, if the embattled site has to keep criss-crossing the seas while fighting legal battles to stay afloat, it might make for another good documentary.

Did The Critics Find Adele's Performance Oscar-Worthy?

Professional awards magnet Adele can now add an Oscar to her growing collection, after her win at last night?s Academy Awards for her James Bond theme ?Skyfall.? And, believe it or not, this is the first time a 007 tune has won in the Best Original Song category!

At any rate, Adele also performed at the ceremony. Some critics were a bit nonplussed over the vocal mix, citing the fact that the London songstress? pipes were drowned out by the orchestra. Still, most were in agreement that the singer herself brought her A game to the Academy?s big night. See our roundup of what the Internet had to say about Adele?s performance of ?Skyfall? below.

:: The Los Angeles Timesfelt Shirley Bassey and Adele?s Bond songs saved the night: ?Like Bassey, she doesn?t succumb to the drama inherent in the song?s big-band orchestration. Adele practically tunes it out, and though Oscar host Seth MacFarlane joked earlier that Adele would be ?shouting? at the audience, she did anything but, keeping her vocals low and her tone slyly conversational.?

:: MTV found nothing to gripe about: ?Adele let loose with her very own James Bond tribute on Sunday night?s (February 24) Oscars. Done up in sequined all-black everything, the diva gave a flawless performance of the theme song for ?Skyfall?.?

:: HitFix felt Adele?s vocals could have been more prominent in the mix: ?All night, the house orchestra tended to overpower vocals ? including on other powerhouse performances from 007-famed Shirley Bassey and Dreamgirls Oscars winner Jennifer Hudson. While Adele kept her kinder notes understated like in the recording, her backing band seemed to challenge her. Great performance on her part, but an iffy mix.?

:: Hollywood.com also lamented the vocal mix: ?In her first televised performance since giving birth to her child, Adele belted out Skyfall?s title track to the excitement of many. But from the second she stepped out on that Oscar stage (introduced by America?s other favorite no-filter queen, Jennifer Lawrence), the emotional rollercoaster we were ready to board was not ready for us. The mix seemed to overpower Adele ? an impressive feat considering the strength the singer holds in her incredible vocal chords ? and she seemed visibly frustrated through the entirety.?

:: Billboard was blown away: ?With hair down and gold sequined black dress shimmering, Adele did her trademark stand-and-sway and this-big hand gestures as a full chorus and massive backing band (complete with a 15-plus orchestra) brought the layered, building track home.?

:: E! concurred: ?It was a simple setup: Some glittery jewels hanging as a backdrop, a band and Adele, with her killer voice and and the sparkliest dress we ever did see. And as with all things that Adele does, we think it was perfect.?

:: Finally, Chart Rigger had this to say: ?I truly love Adele?s Platinum-selling ?Skyfall,? and think it deserved to win the Golden Globe, BRIT Award and, now, Academy Award that its racked up. And while her performance of the James Bond theme at the Oscars last night was truly grand, it was really Dame Shirley Bassey who stole the effing show with ?Goldfinger?.?

Tell us a little background on this home: My clients purchased this 1,468-square-foot, two-bedroom, one-bath 1920s Greenland Hills Tudor as a short sale in December 2012. Acura comes roaring back with NSX supercar

These days, it?s common for automakers to display ?concept cars? on the auto show circuit that are thinly disguised versions of upcoming production models ? like the MDX Acura introduced at the Detroit Auto Show last month.

But the show car that drew the real crowds was a model that won?t hit the street for at least two years, the reincarnation of Acura?s once formidable NSX supercar.

The Japanese maker is desperately hoping that the re-born NSX will grab the high-line brand some much-needed attention and bring curious new shoppers into Acura showrooms even before it reaches production.

When it was launched more than a quarter-century ago, Acura transformed the way Americans thought about Japanese cars, proving that the Asians could challenge the well-established European and domestic luxury brands. But the initial success of the Honda Motor Co. subsidiary proved far too fleeting and in recent years, Acura has lagged in the back of the premium pack.

?It was a brave experiment when it was first launched,? says automotive analyst George Peterson, of AutoPacific, Inc. And now, he adds, there are signs Acura ?has hit bottom and is on the upswing.?

That was clearly something the maker intended to prove when it invited automotive journalists to the race track in Sonoma, California, several weeks back, to check out the new Acura RLX and pit it against some of its most formidable competitors, including the Mercedes-Benz E-Class and BMW 5-Series.

?This is a big deal for us,? asserted Mike Accavitti, the marque?s head of marketing. ?It?s the best product we have ever built.?

What the Honda subsidiary has pronounced its new ?flagship? is the direct heir to the original Acura Legend, a stylish and technically sophisticated product that turned conventional wisdom on its head. Produced in both coupe and sedan body styles, the original Acura model quickly ran up the sales chart and, if anything, created a conundrum for Honda officials who feared the Legend nameplate was better known than that of Acura itself.

Their solution proved disastrous. They not only replaced the Legend but switched to a new, European-style alphanumeric nameplate strategy for its replacement ? and for the new models to follow. The problem is that the cache of the original products was lost and motorists became completely confused by the new names; was the new flagship the RL or TL was a frequently heard question.

?Internally, they believe that (name) change cost them $1.5 billion in lost sales,? says Peterson, who has worked with Acura strategists over the years to figure out how to regain lost momentum.

Compounding the situation, Acura faced a wave of new competitors, including the even more up-market Japanese upstarts Lexus and Infiniti, launched by Toyota and Nissan respectively, which looked at Acura as a ?case study,? says the analyst.

Acura seemed to be regaining its footing in the early days of the new Millennium with an assortment of products such as the downsized RDX crossover, sales climbing to a record 209,610 in 2005 and putting it within striking distance of the first-tier luxury brands.

But then, industry observers suggest, the Honda subsidiary again shot itself in the foot with a series of new mistakes, such as the introduction of an oversized chrome grille shield that has been derisively dubbed the ?beak.?

The new RLX and upcoming MDX feature a significantly smaller version of that shiny proboscis, but Acura remains committed to the alphanumeric nameplate strategy despite senior officials admitting it still confuses many customers.

But they?re hoping that a broader product line that is receiving generally positive reviews will overcome such concerns. It should also help, said Accavitti, to have new products like the Acura RLX offered at prices ?$1000s less than comparably equipped competitors.?

In keeping with its roots, meanwhile, the new models will also put an emphasis on advanced technologies, from state-of-the-art infotainment systems to the electric Super-Handling All-Wheel-Drive Acura will launch in the coming year.

That technical mouthful, abbreviated as e-SH-AWD, is a hybrid drivetrain that can deliver excellent fuel economy in routine driving but transform a vehicle like the RLX into a serious performance machine when the driver stomps the throttle. The unusual layout, which uses a V-6 gas engine and three electric motors also can direct power to individual wheels to help improve handling in aggressive turns, a concept known as torque vectoring.

An even more aggressive version of the system will be the fast-beating heart of the NSX, which is expected to debut in late 2014 or early 2015, Acura officials hint.

The maker clearly needs the boost. Sales tumbled to just 105,723 in 2009, a notably sharper downturn that the overall U.S. automotive market. Last year, the maker posted a strong gain, but at 156,216 cars and crossovers it was still down nearly 25% from its all-time high.

The new year is off to a good start, January volume up about 13%, year-over-year, buoyed by other new models such as the entry-lux sedan the Acura ILX.

Acura still has some serious challenges to overcome, but the maker appears to be making inroads after what some have dubbed a lost decade. It helps to have new products at the top and bottom of the luxury range ? and a striking new NSX supercar in the offing that packs potential buyers in whenever it goes on display.

Boeing gives regulators its plan to fix Dreamliner batteries

WASHINGTON/SEATTLE (Reuters) - Boeing Co on Friday gave U.S. aviation regulators its plan to fix the volatile battery aboard its new 787 Dreamliner, even though investigators have not yet determined what caused the batteries to overheat on two planes last month.

Boeing did not propose abandoning the lithium-ion batteries and is not working on a backup or longer-term fix for the problem that has grounded its entire fleet of 50 Dreamliners for nearly five weeks, three sources familiar with the plan said.

The company and the U.S. Federal Aviation Administration said no firm result emerged from the meeting between Deputy Transportation Secretary John Porcari, FAA Administrator Michael Huerta and other FAA officials and Boeing Commercial Airplanes CEO Ray Conner and other senior Boeing executives in Washington.

With Boeing's costs mounting by millions of dollars a day while the planes are on the ground, the FAA said it is "reviewing a Boeing proposal and will analyze it closely. The safety of the flying public is our top priority and we won't allow the 787 to return to commercial service until we're confident that any proposed solution has addressed the battery failure risks."

Boeing declined to comment on the details of its proposal, but said the meeting with the FAA was productive.

The proposal to the FAA includes measures to address a range of possible causes of short-circuits in the batteries, the sources said.

Five weeks ago, U.S. authorities grounded the worldwide fleet of 787s. U.S., Japanese and French investigators are still not certain what caused the battery fire aboard an All Nippon Airways 787 in Boston and an overheated, smoking battery on a Japan Airlines 787 in Japan.

The proposed fix includes adding ceramic insulation between the cells of the battery to help keep cells cool and prevent a "thermal runaway" in which one cell overheats and triggers overheating in adjacent cells. It also includes building a stronger, larger stainless steel box with a venting tube to contain a fire and expel fumes outside the aircraft should a battery catch fire again, the sources said. In addition, the plan proposed wiring changes, self-torquing screws that will not come loose and battery alterations to prevent moisture and vibration problems, one of the sources said.

But there was also a plan to use a different battery type or some other longer-term fix, the sources said.

"I have talked to a number of people who are working directly on these batteries. No one is on the Plan-B team," said a person familiar with Boeing's efforts who was not authorized to speak publicly about them.

A second source, who also was not authorized to speak publicly, said Boeing does not view its proposal as a temporary "band-aid" that would be supplanted by another solution later.

Boeing spokesman Marc Birtel said in a statement: "We are encouraged by the progress being made toward resolving the issue and returning the 787 to flight for our customers and their passengers around the world."

Birtel reiterated that hundreds of engineers and technical experts are working "around the clock" to return the 787 fleet to service. "Everyone is working to get to the answer as quickly as possible and good progress is being made," Birtel said.

Boeing's stock closed up 65 cents, or 0.86 percent, at $75.66 on the New York Stock Exchange.

Richard Aboulafia, aerospace analyst with the Teal Group in Virginia, said Boeing needed a backup plan in case the FAA did not approve its proposal.

"It's a bit tone deaf to propose containment and management when the political winds are favoring an elimination of the risk," he said, citing Transportation Secretary Ray LaHood's insistence that the plane would return to flight only when it was "1,000 percent safe" and similar remarks by other officials.

"They need to be out there talking about a bigger solution beyond mere containment because the political winds and public opinion are not going to favor a solution that's focused on fire and smoke management," Aboulafia said.

He noted that Airbus had already signaled its plan to switch back to more traditional nickel cadmium batteries for its A350 airliner, but the 787 was far more dependent on electrical power, which would complicate any effort to switch to a different type of battery. A complete redesign could take around nine months to implement, he said.

Another source said that kind of solution could take two years if, for example, Boeing decided to use nickel cadmium batteries on the 787, similar to those used on the 777 jet.

The U.S. National Transportation Safety Board is still investigating the Boston fire and the Japan Transportation Safety Board is investigating the battery failure in Japan. Neither has found a root cause for the problems.

The sources said the NTSB might never find the cause because the battery in Boston was severely damaged by the fire.

Given the financial cost of the grounding for Boeing and the airlines that own the jets, estimated at $200 million a month, Boeing decided to address all possible causes with the measures, rather than wait for the NTSB to identify one specific cause, the sources said.

Boeing engineers have been working with outside experts and U.S. government officials to address possible cause of the battery issues. The team includes experts from the U.S. Navy and the National Aeronautics and Space Administration, which uses a lithium-ion battery on board the International Space Station.

Boeing engineers went through a "fault tree" and "came up with a list of half a dozen things that could have led to problems," said a congressional source who had been briefed on the matter, but was not authorized to speak publicly.

"They have a list of things that it could be, and the fixes are designed to address that list of problems," the source said.

If the NTSB's investigation turns up additional possible causes, those would be added to the mix, another of the sources said.

Boeing machinists already are building the new containment boxes for the battery, a sign the company is confident that the FAA will eventually approve continued used of lithium batteries and the contain-and-vent strategy for dealing with fires, according to a person familiar with the matter.

The FAA granted Boeing permission to use lithium batteries in 2007, but set nine special conditions the company had to meet.

Asked why the company's extensive testing of the batteries had not revealed problems with the batteries and the electrical systems used to operate them, one of the sources said test environments had limitations and the real test of an aircraft always came when it was actually operating.

If the Boeing plan is approved by FAA Administrator Huerta and Transportation Secretary LaHood, company officials expect the 787 fleet to return to service within eight weeks, one source said.

Another source, who is also familiar with the 787 investigation but not authorized to speak publicly, said a key challenge for Boeing would be to redesign the battery box so that it could truly contain a fire if one occurred.

Despite Boeing's statements about containment being the plan for a battery issue from the start, the blue box that held the current lithium-ion battery was clearly "not designed to contain a fire," said the source.

Another person familiar with the engineering work said the new box would be made of stainless steel nearly half an inch thick. It would be capable of containing an explosion, and would have a tube to vent smoke and flame outside the jet.

However, the source said engineers have raised questions about the safety of venting flames outside the plane, especially if it is on the ground and being fueled. The effect could be something like a flamethrower, this person said.

(AP) ? Appearing last year before Taiwanese regulators, billionaire media magnate Tsai Eng-meng appeared perplexed over a decision to fine his flagship newspaper for carrying camouflaged advertising on behalf of China's Communist government.

"I really don't understand this," said Tsai, who became Taiwan's richest individual by selling treacly rice crackers on the Chinese mainland through his Want Want China Holdings company. "I think they should allow me to make this money."

It was a vintage statement from a man Forbes magazine says is worth $8 billion and whose pro-China views have made him a lightning rod for criticism among many on this democratic island of 23 million people. Since purchasing Taiwan's China Times Group in 2008, the rough-hewn Tsai has burst like a meteor onto Taiwan's political scene, leveraging his China-derived fortune to promote a political union across the 160-kilometer- (100-mile-) wide Taiwan Strait. Despised by Taiwan's Beijing-wary opposition, the crew-cut 55-year old seems to roll effortlessly over his detractors, proudly flaunting his limited formal education and soaring business success.

Now he seems ready to roll over them again. Next month Taiwanese officials will rule on his bid to take a 32 percent share ? through his son ? in the Next Media Group, owned by Hong Kong's Jimmy Lai, an outspoken anti-communist reviled in Beijing. Next properties include Apple Daily, which is Taiwan's biggest selling newspaper, and Next Magazine, its pre-eminent investigative journal.

If the deal goes through, Tsai would add substantially to his existing ownership of another major newspaper, an influential business daily, a top-rated cable TV news station, and a popular terrestrial TV channel. Critics, who believe Tsai uses his media empire's consistently laudatory coverage of China to advance his mainland business interests, say this new level of clout could stifle Taiwan's press competition and even undermine its young democracy.

The controversy over Tsai and his expansive Taiwanese media holdings goes right to the heart of the dominant issue in Taiwanese politics: Whether the island should attempt to maintain the separate political identity from the mainland it has maintained since splitting apart from it amid civil war in 1949, or whether it should bow to China's increasing political and economic might and accept its sovereign sway. Taiwanese media, particularly the island's four national newspapers and its seven major 24-hour cable news stations, play a crucial role in the debate, using their columns and broadcasts to promote the competing pro-China and independence agendas of the two main political parties.

The strength of Tsai's pro-China views were underlined in January 2012 when he told the Washington Post newspaper that he unreservedly backed Taiwan's unification with the mainland. "I really hope that I can see that," he said. In the same article he also attacked the widely held belief that Chinese security forces killed hundreds if not thousands of demonstrators during pro-democracy protests around Beijing's Tiananmen Square in June 1989, citing the refusal of a phalanx of Chinese tanks to run over a famously bold protester as evidence of the forces' restraint.

Want Want's own internal newsletter reported in its December 2008 edition that during a meeting in Beijing, Tsai told Wang Yi, head of the Chinese government's Taiwan Affairs Office, that Tsai had acquired the China Times Group "in order to use the power of the press to advance relations between China and Taiwan." The newsletter quoted Wang as saying that if Tsai's company had any future needs "the Taiwan Affairs Office will do its best to help it, including giving support to its food business."

After a lengthy exchange of emails with a Tsai legal representative, Tsai declined to be interviewed for this article. Contacted by The Associated Press, his public relations department also declined to answer questions on Tsai's China attitudes and his plans for Next Media. "We do not plan on repeating ourselves again," wrote his son, Cai Shao-zhong, explaining that Tsai had outlined his views in other forums in the past.

Interviews with media figures and former employees help fill in the blanks about Tsai. They paint a picture of a hard charging, detail-oriented businessman, loyal to his friends, but implacably hostile to anyone he feels is getting in his way. They also suggest he either lacks an understanding of the role of the media in Taiwan's democracy or does not consider it important.

"My understanding of Tsai is that's he's a businessman, all his thinking is about business, and how to make money," said Ho Jung-shin, who left his job as deputy editor of Tsai's flagship China Times newspaper last year over what he said was Tsai's use of his sprawling media holdings to conduct vendettas against perceived enemies.

Ho said he was particularly upset by repeated China Times Group claims, which the group later backed away from, that a researcher at Taiwan's prestigious Academia Sinica paid university students to mount demonstrations against Tsai's efforts to purchase a major Taiwanese cable TV distribution system. Regulators on Wednesday nixed that deal, at least in its present form.

"He took this public trust and turned it into a personal tool," Ho said. "He's sees the media only as a tool to advance his own campaigns."

Other former China Times employees also lambast him for turning both the China Times newspaper and the CTi cable news station into rubber stamp apologists for China's authoritarian government. They cite a long litany of examples, including the two outlets' harsh criticism of the Dalai Lama during a 2009 Taiwan visit ? Beijing reviles the Tibetan spiritual leader for allegedly promoting Tibetan independence ? and the short shrift the outlets gave imprisoned Chinese dissident Liu Xiaobo when he was awarded the Nobel Peace prize in 2010.

Taiwanese newspaper columnist Antonio Chiang, a longtime Tsai acquaintance, said a key to understanding Tsai's larger than life personality is the intense pride he feels at having taken over his father's small food business as a young man in the late 1970s and building it into what is now China's largest snack food company, despite having never finished high school.

"He's always talking about how little education he had and how it didn't hurt him in the least," said Chiang, who strongly opposes Tsai's views on China. "He loves the fact that he has all these PhDs working for him and that they have to listen to what he says."

"This is a man with extremely strong will," Chiang said. "He's not very sophisticated but he's very self-controlled. And he's completely honest. What you see from him is exactly what you get."

The lack of pretense Chiang describes is reflected in Tsai's unpolished persona, which includes a shoot from the hip social style and a preference for his native Taiwanese dialect over the clipped, Mandarin Chinese employed by the better educated doyens of the Taiwanese business elite.

A 2012 Chinese language biography portrayed him as a simple man of the people, most comfortable chewing betel nut and conversing informally with food processing workers amid a hands-on management style that includes familiarity with every aspect of his business, from buying raw materials to managing production lines and kibitzing with customers.

But Chiang said that beneath Tsai's everyman personality is a single-minded approach that threatens Taiwan's free press, including the Apple Daily newspaper, Chiang's current employer, and Next Magazine, the investigative journal.

Apple, while better known for its racy diet of sex, scandal and celebrity gossip, has also been praised for its editorial independence that sets it apart from most other Taiwanese media outlets, which seem most comfortable parroting the views of one or the other of Taiwan's two main political parties.

"He ruined the China Times," Chiang said. "He can ruin Apple as well."

Tsai has also stirred controversy by taking initiatives that appear aimed at bringing Taiwan and China closer together on important foreign policy questions.

Last September, Tsai contributed five million New Taiwan dollars ($166,000) to underwrite the voyage of some 60 Taiwanese fishing vessels to an island group in the East China Sea hotly contested by China and Japan. The voyage ended in a confrontation between Japanese and Taiwanese coast guard cutters, significantly raising tensions in the area, despite the declared intention of Taiwanese President Ma Ying-jeou to avoid taking provocative actions on the sensitive island issue.

Fishermen involved in the demonstration said they were only interested in asserting their fishing rights around the Diaoyu, or Senkaku islands, and had no interest in politics, or making common cause with China. But 11 days after they returned to Taiwan, the China Times ran a hard-hitting editorial, calling on the Taiwanese government to join Beijing in pushing for Chinese sovereignty there.

Initiatives like this are feeding the belief among Tsai critics that he and other deep-pocketed Taiwanese business people are attempting to subvert the Ma government's relatively cautious China policy, which while consciously moving the island ever closer to Beijing economically, still opposes an early political union.

"These business people are definitely pushing the two sides closer together," said Ketty Chen, a Taiwanese-American academic at Taipei's National Taiwan University. "They're very influential."

Arrayed against the influence of Tsai and his pro-China allies is Taiwan's boisterous democracy and the blossoming among many Taiwanese of a political and cultural identity distinct from the mainland.

"I wouldn't sell Taiwan short," said Taiwan expert Mark Harrison of the University of Tasmania in Australia. . "It won't surrender without a fight. This battle isn't over."

The most common way to mess around with how a file sound is equalization, which amplifies some frequencies and/or attenuates others. Plenty of apps do that.

  • If you use iTunes Match, you don?t mind going in to Apple?s Music app and making those files download to your phone.
  • You make all of your playlists in iTunes (you can?t make playlists within this app).

Do those sound familiar? Yes? Then let?s proceed.

After testing SonicMax Pro, we can verify that it makes music sound more present. HP's 1Q offers glimmer of hope, stock surges

SAN FRANCISCO (AP) ? Hewlett-Packard Co.'s latest quarterly results provided a glimmer of hope after months of gloomy news.

The fiscal first-quarter numbers announced Thursday topped what the slumping personal computer maker's own management and stock market analysts had forecast.

Like other PC makers, HP has been struggling to adapt to a shift toward smartphones and tablet computers, which are siphoning sales from desktop and laptop machines made by HP and other companies. Adding to the problems were some acquisitions gone awry. Over the past two quarters, HP announced losses totaling $15.3 billion as the company accounted for those mishaps, to the shock of Wall Street. The jolt caused HP's stock to plunge to its lowest price in a decade just three months ago.

The shares have rebounded since then, though they still remain about 20 percent below where they were in Sept. 2011, when the company fired Leo Apotheker as its CEO and hired Meg Whitman, who became a high-tech star while running eBay Inc.'s online marketplace.

The same problems are still plaguing HP, but signs of progress in the latest quarter indicated that the company's turnaround efforts are running ahead of schedule. Whitman has consistently said it may be several years before HP is on solid ground again.

She said the company is in the best condition since she was hired as CEO. "The patient showed some improvement," Whitman told The Associated Press in a Thursday interview.

She stopped short of predicting HP will be fully cured more quickly than she anticipated. "I don't want to get out over my skis." Whitman said.

In a show of confidence, HP provided an earnings forecast for the Feb.-April quarter that was higher than analysts' projections.

The company's stock rose 94 cents, or 5.5 percent, to $18.04 in after-hours trading. At its recent low, the stock was down to $11.35.

HP earned $1.2 billion, or 63 cents per share, in the three months ending Jan. 31. That was a 16 percent decrease from nearly $1.5 billion, or 73 cents per share, at the same time a year earlier.

Excluding certain accounting items, HP would have earned 82 cents per share. That was well above the average estimate of 71 cents per share among analysts surveyed by FactSet.

Revenue fell 6 percent to $28.4 billion, about $470 million above analysts' projections. It was nearly $30 billion a year earlier. It's the sixth consecutive quarter that HP's revenue has dropped from the previous year.

Excluding one-time items, HP expects to earn 80 to 82 cents per share in the current quarter. Analysts estimated earnings of 77 cents per share.

HP isn't predicting when its revenue downturn might end. In a conference call with analysts, Whitman said HP still faces a "long road ahead" before its revenue is growing again. To help offset the revenue decline, HP is in the process of eliminating 29,000 jobs, or about 8 percent of the workforce when it was announced, in a streamlining scheduled to be completed by Oct. 2014. Whitman said about 15,300 of the jobs targeted in the cost-cutting program have been jettisoned so far. About 3,500 people left in the most recent quarter.

The Palo Alto, Calif., company's biggest headaches remain rooted in the HP division that includes PCs, where revenue fell 8 percent from the previous year. Printer sales also continued to slide, although not quite as severely, with a 5 percent decrease.

Whitman is trying to reverse the trend by expanding into tablet computers and selling an array of machines running on Windows 8, a radical redesign of Microsoft's widely used operating system.

HP had tried to previously challenge Apple Inc.'s trend-setting iPad in 2011 with a tablet running on software that it acquired from Palm Inc., only to quickly abandon the device. The company's latest tablets run on Windows 8 or scaled-down versions of that operating system.

Whitman also believes HP could benefit from rival Dell Inc.'s agreement to sell itself to CEO Michael Dell and a group of investors for $24.4 billion. If it's approved the deal could saddle Dell with an additional $15 billion in debt ? a burden that Whitman believes will raise questions about the company's ability to innovate and tend to the needs of its corporate customers.

"It is an opportunity for us because I know firsthand what instability is like," Whitman said in the AP interview. "I think we are really well positioned for this next big shift in technology. We are excited about it and feel good about where we are."

Dell's decision to end its 25-year history as a publicly traded company has spurred speculation that HP might take a radical step, too, to boost its stock price. The most popular theory is that HP will sell or spin off its PC and printer operations to concentrate on more profitable technology markets in business software and various services.

"We have no plans to break up HP," Whitman said in an interview. "We are convinced that these divisions are better together than they are alone."

The ability to easily jump right into PS4 games and try out titles via streamed gaming is a huge addition for Sony, which had more limited demo capability in the PS3 PlayStation store which required sizeable downloads when it was even available (which wasn?t for every title). Inviting players to join and watch your game also includes the ability for spectators to chim with with on-screen comments as you play, and the ability to take over your controller to help you out if you run into trouble. It?s a much more social version of Nintendo?s handholding modes in recent releases.

Will gamers opt to call a friend, so to speak, instead of jumping on GameFAQs? That?s a good question, but clearly the company is doing everything it can to try and build a real social network, instead of the loosely affiliated group of often crude, sometimes racist anonymized gamers that made up the PlayStation Network of the past.

Former New Orleans Mayor Ray Nagin pleads not guilty in court Wednesday

Former New Orleans Mayor Ray Nagin appeared before magistrate judge Sally Shushan on Wednesday and pleaded not guilty to corruption charges.

Nagin appeared in court at 2 p.m. It took less than 15 minutes for the afternoon proceeding.

In magistrate court, a defendant can only plead not guilty. A magistrate judge then sets bond, hearing dates and a tentative trial date. A not guilty plea in front of a magistrate judge is required as a formality for anyone indicted on criminal charges.

Nagin's trial was set for April 29 at 10 a.m. His bond was set at $100,000 and he was asked to surrender his passport.

Nagin was charged in a 21-count indictment on Jan. 18. The charges include bribery, conspiracy, money laundering and more.

The indictment says Nagin accepted bribes from Frank Fradella, including $50,000, granite inventory, and nine payoffs in the form of wire transfers from Fradella totaling $112,500.? The indictment also said that Nagin accepted approximately $72,250 in bribes from Rodney Williams and his company, Three Fold Consultants, LLC.

The indictment charges Nagin with accepting bribes and payoffs from consultants and contractors, money laundering conspiracy and filing false tax returns from 2005 to 2008.

Bankrupt San Bernardino hires new manager for California city

LOS ANGELES (Reuters) - Crisis-hit San Bernardino, California, picked a new city manager on Friday at a critical time in its quest to get bankruptcy protection from a federal court.

San Bernardino was forced to look for a new city manager after its acting city manager, Andrea Travis-Miller, quit.

Her resignation coincides with the departure of the city's finance chief. Both had been the key officials overseeing the city's bankruptcy application and their departures threaten the city's ability to achieve it. They had more knowledge than anybody else of the city's finances and the experience to answer questions from the court and creditors.

The city council voted to hire Allen Parker to replace Travis Miller. According to his resume provided to the city, Parker has been an economic development consultant since 2006.

From June 2001 until December 2006, according to his resume, Parker was chief administrative officer of the Morongo Band of Mission Indians, a federally recognized tribe in California. Before that he was village manager of Maywood, Illinois.

The federal judge overseeing San Bernardino's bankruptcy application said in a court hearing on Tuesday that the new city manager would be confronted with a steep learning curve.

Various creditors are demanding a wealth of financial documents from the city. The city must also produce a detailed bankruptcy blueprint to explain how it intends to deal with its creditors, a key part of proving its eligibility for bankruptcy.

The city council considered two applicants for the job, and voted unanimously to hire Parker.

"Allen Parker brings a wealth of city management experience to San Bernardino," the mayor, Pat Morris said. "I have great confidence in his ability...to guide San Bernardino through the difficult decisions we must make in bankruptcy."

San Bernardino, a city of 210,000 about 60 miles east of Los Angeles, filed for bankruptcy protection on August 1, citing a $46 million deficit for the current fiscal year and little scope to meet its day-to-day expenses. It was the third California city to file for bankruptcy last year, following Stockton and Mammoth Lakes.

The city's biggest creditor, the California Public Employee Pension Fund (Calpers), has opposed San Bernardino's quest to seek bankruptcy protection. Without it, the struggling city will likely face multiple lawsuits in state court for unpaid bills, at a time when its officials say it can barely make payroll.

The city pegs its debt to America's biggest public pension fund at $143 million.

San Bernardino has not made its $1.2 million, twice monthly payment to Calpers since its bankruptcy declaration last August.

No city has ever unilaterally suspended payments to Calpers, which manages pension plans for state government employees and many municipalities and local government agencies around California.

The bankruptcy could be a test case as to whether the pensions of government workers take precedence over other payments in a municipal bankruptcy - a high-stakes issue for pension plans and their beneficiaries, and for the Wall Street bondholders who lend money to governments.

In a statement, Calpers said: "We are very pleased to have Mr. Parker stepping into his new role as city manager of San Bernardino and our executives have already reached out to him personally to welcome him and begin a dialogue with Calpers."

Conclave's rituals, oaths and secrecy explained

VATICAN CITY (AP) ? It's a ritual as rich in tradition and symbolism as the Catholic Church can muster: secret oaths, hypnotic Gregorian chants, scarlet-decked cardinals filing through the Sistine Chapel ? all while the public outside in St. Peter's Square watches for white smoke or black to learn if it has a new pope.

Much of the ritual's current incarnation is the work of Archbishop Piero Marini.

The Vatican's master of liturgical celebrations for two decades under Pope John Paul II, Marini organized the funeral rites for the late pontiff and the conclave that elected Pope Benedict XVI. He was by Cardinal Joseph Ratzinger's side minutes after the election when the new pope uttered the words "I accept" ? officially launching his papacy on April 19, 2005.

"I still remember, with some emotion, the silence that there was ? the participation of the cardinals," Marini recalled in an interview in his Vatican offices. "It was an event that had been prepared with great care."

Next month's conclave to elect the 266th leader of the world's billion Catholics will have all the grand trappings of papal elections past ? with the added twist that this time around the current pope is still alive.

Benedict's resignation, the first papal abdication in 600 years, has caused chaos in the Vatican: Nobody knows for sure what he'll be called much less what he'll wear after Feb. 28. But one thing is clear: The rules and rituals to elect his successor will follow Marini's "bible" of how to run a conclave ? a dense tome of footnoted decrees, floor-plans, directions and photos. The book will serve as a guide when 117 cardinals gather in the Sistine Chapel to elect Benedict's successor.

The Vatican said Saturday that the Holy See in the coming days or weeks would publish an update to the main apostolic constitution that guides the papal transition with some ceremonial tweaks, perhaps taking into account the influence of Benedict's more tradition-minded master of liturgical ceremonies who replaced Marini in 2007. But the fundamentals will likely remain.

The conclave begins with the cardinals in their red cassocks filing into the Sistine Chapel, chanting the monophonic Litany of Saints followed by another sacred song, Veni, Creator Spiritus, imploring the intervention of the saints and Holy Spirit as they take their places before Michelangelo's "Last Judgment."

The cardinals place their hand on the Gospel and promise to observe absolute secrecy both during and after the conclave, and to "never lend support or favor to any interference, opposition or any other form of intervention ... in the election of the Roman Pontiff."

While the Vatican is notoriously obsessed with secrecy, there are actually good historical reasons why conclave proceedings are kept quiet and why cardinals promise to vote independently, said Monsignor Robert Wister, professor of church history at Seton Hall University in New Jersey.

Up until the early 20th century, papal elections could be vetoed by the kings of France, Spain or the Holy Roman Emperor, Wister noted. The power was rarely invoked but was used in the 1903 conclave to replace Pope Leo XII. Leo's No. 2, the Vatican's secretary of state, was in the lead when his election was blocked by Austrian Emperor Francis Joseph.

The eventual winner, Giuseppe Melchiorre Sarto, took the name Pius X ? and promptly abolished the veto power. Still, the memory of outside intervention has continued to weigh over the College of Cardinals, leading them to be sequestered until they have a pope.

Now they have a Vatican hotel to stay in while not voting, but are forbidden from having any contact with the outside world: no phones, no newspapers, no tweeting.

"There is that fear," Wister said. "Going back previous centuries, kings did interfere, sometimes with an army."

Secrecy under penalty of excommunication also ensures that the winner doesn't know who among his cardinals voted against him ? an important element going forward to keep the church's top leadership unified.

"It's not the Renaissance where he'd be poisoned, but it's a matter of human respect," Wister said.

Once the final oath is taken, the master of liturgical ceremonies gives the order "Extra omnes" (everyone out) and all those not taking part in the conclave leave the frescoed walls of the chapel.

An elderly cardinal, over age 80 and thus ineligible to participate, remains and reads a meditation about the qualities a pope should have and the challenges facing the church, after which he and the master of ceremonies leave the cardinals to begin voting.

On Day 1, only one round of balloting is taken; after that cardinals cast two votes in the morning, two in the afternoon until they have a victor. A two-thirds majority is necessary.

Each cardinal writes his choice on a paper inscribed with the words "Eligo in summen pontificem," or "I elect as Supreme Pontiff." They approach the altar one by one and say: "I call as my witness, Christ the Lord who will be my judge, that my vote is given to the one who, before God, I think should be elected."

The folded ballot is placed on a round plate and slid into an oval urn. After the votes are counted and the outcomes announced, the papers are bound together with a needle and thread, each ballot pierced through the word "Eligo." Then they are burned with a chemical to send black smoke (meaning no) or white (meaning yes) out of the Sistine Chapel's chimney.

On April 19, 2005, a stunned Ratzinger accepted the charge and was brought into a side room to change into the white vestments of the papacy. Off came the scarlet cassock; underneath was the simpler black clerical garb of a cardinal.

"Naturally the pope couldn't change completely at that moment, so he went out with those black sleeves ? we could see his sweater!" Marini recalled. "But even that was a human gesture of how he was dressed as a cardinal."

Marini accompanied Ratzinger out onto the loggia of the basilica overlooking St. Peter's Square where a cardinal announced "Habemus Papam" (We have a pope) to the thousands of people below. The cardinal announced Ratzinger's name in Latin, and then Benedict uttered his first public words as pope, saying he was but a "simple, humble worker in the vineyard of the Lord."

Marini noted that that first encounter of the new pope with his flock traces its history to the ancient tradition that the bishop of Rome is elected by the people.

"This appearance by the pope on the balcony, the applause and cheers of joy that erupt when he comes out," he said, "in some way represents the Roman people accepting their pope."

It's one of the potent symbols of a tradition-drenched conclave.

"A religion relies on its customs and practices," said Monsignor Kevin Irwin, former dean of theology at Catholic University of America and professor of liturgy. "This is not like putting up posters and getting a poll of who is winning. This is an act of God."
