Canada?s hot condo market set to get even hotter

TORONTO ? A new condo report suggests first-time buyers, retirees and population growth will continue to fuel demand and price growth for the compact living spaces over the next few years.

The study by Genworth Canada found that average condo resale prices are expected to rise next year in seven of the eight metropolitan centres studied.

Prices in Toronto are projected to jump 2.5% to $312,352.

The highest increase however, is expected to be in Edmonton where prices could rise 3.2%.

Vancouver is the only city where condo prices are expected to drop, by 2% to $348,152.

The report stands in contrast to warnings from economists and officials that the condo market in some hot markets is reaching bubble territory that could soon burst.

The Bank of Canada and federal Finance Minister Jim Flaherty have cautioned Canadians repeatedly to moderate borrowing on real estate, declaring household debt to be the domestic economy?s number one enemy.

The central bank noted certain segments of the housing market that have a persistent oversupply ? such as condos in Toronto ? face a higher risk of a price correction.

Genworth ? which earns revenue from selling mortgage insurance ? notes that rising prices for single-detached homes are driving first-time buyers to condos, but retirees also continue to prop up demand.

It suggests that the population is expected to grow in all eight cities studied over the next few years, while employment growth and low interest rates should also support the market.

?This data corroborates our view that the demand for condos in Canada, particularly at the price-point we insure, is well supported by our economy and our population,? said Brian Hurley, chairman and CEO of Genworth Canada.

?For those seeking to own a home affordably in urban centres, condos remain a good option.?

The Genworth Canada report, produced with the Conference Board of Canada, reviewed trends in
Quebec City, Montreal, Ottawa, Toronto, Calgary, Edmonton, Vancouver and Victoria.

Census figures for 2011 released in February show multi-unit dwellings ? a category that includes condominiums ? making up roughly half of all new housing stock, a category traditionally led by detached homes.

The numbers also indicate that Canadians are flocking to urban centres. Toronto?s population jumped more than 17% over the previous census period in 2006.

A recent CMHC report said housing starts and home sales have been strong in 2012 ? particularly when it comes to multiple-dwelling units such as townhouses, condos and apartments ? but will soften moderately in coming months into 2013.

Being in good shape in your 30s through 50s not only increases life span but also improves quality of life for decades to come. Katherine Harmon reports

Being physically active has numerous benefits. Now a study has looked closely at the effects of fitness in the midlife years for preventing debilitating chronic diseases later.

The ongoing study gathered fitness stats for more than 18,000 adults, and followed their health status into old age. Assessing 40 years of that data, the analysis finds that those who had higher fitness levels in their 30s, 40s and 50s were substantially less likely to have a chronic condition between the ages of 70 and 85. The findings are in the Archives of Internal Medicine. [Benjamin Willis et al., Midlife Fitness and the Development of Chronic Conditions in Later Life]

Physical fitness seemed to stave off heart disease and heart failure, which might not be a big surprise. But it also reduced rates of diabetes, kidney disease and even Alzheimer's disease.

Current recommendations suggest adults make time for at least 20 minutes of moderate to vigorous physical activity a day, such as fast walking, jogging, biking or swimming. Busy middle-aged people might find it especially hard to make time for such exercise. But a small investment looks like it could pay big health dividends for decades to come.

E 300 BlueTEC HYBRID

As it celebrates its market launch, the E 300 BlueTEC HYBRID has also obtained its Environmental Certificate in accordance with ISO standard 14062.

This award is based on a life cycle assessment, in which the independent inspectors of T?V S?d subject the vehicle to comprehensive tests covering the entire life cycle.

The E 300 BlueTEC HYBRID, is Mercedes-Benz? first diesel passenger car to feature a hybrid drive. The model is rated in energy efficiency class A+ and has now received the Environmental Certificate from T?V S?d.

"After introducing the S 400 HYBRID in 2009, Mercedes-Benz is now setting new standards for luxury-class business vehicles with the E 300 BlueTEC HYBRID," explains Professor Herbert Kohler, chief environmental officer for Daimler AG. "The modular hybrid technology is opening the way for us to quickly expand other model series with the addition of hybrid models."

Over its entire life cycle, from production and use over 250,000 kilometers (155,343 miles) through to recovery, the Mercedes E 300 BlueTEC HYBRID gives rise to 23 percent less CO2 emissions than a comparable E 300 CDI BlueEFFICIENCY.

This is largely a result of the significant reduction in consumption. Compared with the equivalent E 300 CDI BlueEFFICIENCY diesel model, the consumption of the E 300 BlueTEC HYBRID has been reduced from between 6.1 and 5.8 l/100 km to between 4.3 and 4.2 l/100 km (109 g CO2/km) ? depending on tires installed. This represents a reduction of up to 28 percent.

E 300 BlueTEC HYBRID layout

The E 300 BlueTEC HYBRID meets the mandatory recycling rate of 95 percent by weight that will come into force on January first 2015 in Europe. The future requirements of vehicle recycling were taken into account at the development stage, and closing material loops plays an important role here, not only in terms of the metals used.

The E 300 BlueTEC HYBRID makes use of 43 components with a total weight of 41.5 kg, some of which have been produced from recycled plastics.

In addition, the E-Class also features 44 components with a total weight of 21 kg which have been produced using natural materials. The floor in the luggage compartment, for example, is made of a honeycomb cardboard structure, and olive coke is used as an active filter.

Despite odds, Influxis streaming nicely - vybegevil's posterous

Richard Blakely and Jerry Chabolla, friends, founders and owners of local technology company Influxis, moved their company to Santa Clarita from Hollywood in 2007.

Building cutting-edge interactive streaming projects for national advertising agencies and top brands like Warner Bros, Paramount Pictures, Toyota, Sony, Domino?s Pizza, National Geographic and Proctor & Gamble, the two entrepreneurs first set up their company in 2001.

They call themselves the ?streaming experts? and say they?ve landed major clients because Influxis can accomplish what everyone else says is impossible, said CEO Blakely.

?We?re known for coming up with the most creatively challenging solutions for streaming video and audio,? he said.

Companies and creative digital advertising agencies have sought out the company?s expertise when a project was ready to collapse, both entrepreneurs said. But Influxis has pulled off the impossible over and over again, Blakely said.

?Over the years our reputation has really served us well,? he said. ?We work on a lot of different campaigns with different companies that are always trying to top each other.?

Providing business-to-business server, network and support services for companies who want to utilize streaming technologies, Influxis works ?obsessively close? with its customers to help them pull off extremely creative challenges, said Chief Technology Officer Chabolla.

But cutting edge projects are helping to build the Influxis reputation even more.

Remote interaction

Influxis helped develop the first-ever online event where people were able to drive a real Mitsubishi Outlander SUV online via Web-control, using the keyboard, ensuring that there was no perceived delay in driving the vehicle, the men said.

?One of our favorite clients is Yamaha,? Blakely said. ?We had a real piano in a museum that you can play remotely through our servers and network.?

Featured at the 2011 Newport Music Festival, Jeff Hawley, director, customer experience group, for the Yamaha Corp. said in a testimonial that ?Influxis has been a wonderful partner and as Yamaha continues to push the tech boundaries, they always jump to the occasion and help us make it happen.?

?We can work with your developers or can build it for them,? Chabolla said.

Influxis, however, was built by the founders spending their last dollar.

School friends

Born and raised in the San Fernando Valley, the pair moved themselves and their company to Santa Clarita.

?We were good friends since high school,? Blakely said. ?I was into graphic design and programming and Jerry was into animation and drawing.?

In high school the two had thought of starting a computer-based programming and graphic design print shop, but their other jobs got in the way of realizing that dream.

Not long after, however, the two came together to start an Internet-based company.

?Jerry was on board and helped with all the design graphics and animation we needed,? Blakely said.

The pair started their company without any financing right as the dot-com bubble burst ? and no one wanted to invest in an Internet company in 2001, the men said. The original business concept failed and the two started taking on Web design projects to support themselves.

?But we hated not having recurring income, working project to project and eating one month and starving the next,? Blakely said.

Researching hot new technologies, the two young men discovered pretty much no one else was developing streaming and collaboration at the time.

Blakely and Chabolla became obsessed with the concept of a ?connected Web? where everyone using the Internet could see everyone else using it at the same time; similar to how a Webinar operates, but with more sophisticated options. And they found the tool that allowed them to design their masterpiece, Adobe Media Server.

?Richard invested all of our money into the software,? said Chabolla. ?He said, ?If this doesn?t work, we?ll have to go get regular jobs.? Fast forward 10 years later and we?re still here.?

Global growth

In 2007 people were just starting to care about streaming, Chabolla said. Already positioned to serve the market, Influxis grew quickly on that technology wave.

Privately held, Influxis has some 3,000 customers today and the business partners say most of their business is from repeat customers. The company helps two types of clients ? monthly customers and short-term, campaign-based clients.

About 65 percent, of the company?s business is in the U.S. and 35 percent is international, primarily in Europe, Latin America and Asia, Blakely said.

?We got a really great office space in the Valencia Industrial Center, have 30 employees, an operations and call center in one office and another office for development,? Blakely said.

In all they like the SCV.

?Most all of the people are local,? Chabolla said. ?When we moved here from Hollywood there were only four of us but then we grew so scarily fast.?

A successful start-up depends fully on a foundation of employees who can effectively communicate, hustle, and essentially get sh*t done.

Today, you can find these traits in every Distilled team member?communication is the underlining glue that holds us together. Whether it?s talking to another office member or pitching a sensational idea to an eager client, it all boils down to how efficient we are at getting our message across.

However, our communication wasn?t always so good.

Rather, we had to be forced to involve other teammates across offices. We?d discuss ideas awkwardly, not really appreciating what others could bring to the table. It took a while to realize communication was the issue. It?s simple in theory, but in reality, it involves so much more than sending an email or picking up the phone. True communication comes from actually forming a bond with the person on the other side of the conversation, and these relationships are best developed when face to face.

So our execs decided, ?Well, let?s get everyone meeting face to face.? And so we did.

The Details

When Distilled first started, it was easy to keep the building blocks together. A few team members huddled in a small, open office space and not only facilitated communication, but required it. As the business started to expand, first by a few employees and eventually by a few thousand miles, it became clear that as Distilled grew, it would be difficult to work together as seamlessly as before.

So in January 2012, Distilled flew all 50 employees to the U.K. headquarters for the first annual ?Distilled-a-thon,? a week-long event catered to building relationships and boosting moral between all three Distilled offices (located in London, Seattle, and NYC).

The PC version of went down is this:?Through a series of team building exercises, presentations, and meetups, employees were not only able to finally put faces to names, but also develop the level of rapport and trust that is necessary for true, authentic communication.

The real version is this: We got hardly any client work done. We got no sleep. We went on (classy) drinking binges and got to really know each other. So while the team building exercises helped us learn what each person could bring to the table professionally, it was this collective lack of sleep and bonding that helped us learn who each of us was.

While Google Chat and Skype can be great alternatives for everyday communication upkeep, there is absolutely no substitute for an actual, in-person conversation. Email is convenient for quick messages, but lacks the emotional depth necessary to really get to know someone. Everyone responds to conversation differently, and body language is typically the cue we use for determining how to best interact with each other.

By allowing employees to meet and foster those relationships, we were able to understand how to communicate more efficiently on an individual basis, thanks to the cues we gave and received while interacting in person. For example, I learned Mark likes things directly to the point and that Dave can put his head down and get sh*t done like no other. Oh, and you may think Pete is quiet but he?s got damn opinions (and a penchant for whiskey).

It also served as a perfect opportunity for management to share their ideas and visions for the future of the company, boosting moral and providing an opportunity to see exactly what we, as a start-up, have the potential of becoming. Being able to see and interact with people that share the same commitment and drive is inspiring and serves as a good reminder of why we work so hard, so we can all succeed, both as individuals and as a work community.

How to Plan Your Own Meetup

  • Get past the excuses. There are all sorts of excuses for putting off an office-wide meet up. Objections could be the extreme amount of coordination necessary to put day-to-day operations on hold. Another could be the financial aspect involved with getting so many people to one location. While these could be off-putting (especially for a small business or start-up with limited funds) it must be remembered that the foundation of any successful business will always be the team, and it should be considered a serious investment.
  • Make a plan. If the cost factor is scary, research travel sites that offer discounted rates for booking group accommodations. If the coordination of 10+ people sounds like an office nightmare, try an app that will help take the agony out of planning. If putting work on hold for a week is an issue, set aside certain hours each day for client work (but be sure to work on it as a team to continue the ?getting-to-know-you? process).
  • Just do it. There will never be a ?perfect? time to plan an office-wide meetup;?especially in a start-up, there is always work that simply has to be done. But the key to it all is this: By investing time in your team now, you are creating a more engaged and productive team for the future.

To this day, our company-wide meetup proved to be the smartest decision Distilled made on the path to forging a strong foundation and community work environment, and it is hopefully just one of many events we will have in the future. I highly recommend giving it a shot, and hopefully you, too, will see just how much it can change your business and strengthen the foundation on which you will continue to grow.

Ever walked out of your house and locked the door, only to realize that you left your keys inside? Hiding a spare key comes in handy in such cases, and can save you the cost of having to call a locksmith. But where are good hiding places for a key that would be well-hidden and not leave your house vulnerable to being burglarized?

Locksmiths recommend some of the best places and warn against some of the worst places to hide a key.

Best Hiding Places

1. Buried -

If you have a regularly dug up dirt area, put your key in a small, water-tight jar and put it underground or under the mulch.? Just make sure all the ground in the area looks the same and don?t forget where you put it.

2. Inside a combination lockbox -

Anyone who will take the time to bust open your lockbox would simply bust through the window or door anyhow, so this is a good way to deter those who are not so motivated to rob that they don?t care about noise.

3. In the backyard -

Choose a place that is far from the back door.? Stand there and ask yourself where you would look for a key, then put it somewhere else.

4. In the dog house -

If you have a guard dog, this is especially effective.

5. With a neighbor -

This is one of the best ideas.?? More than likely they will be home late at night when you arrive.

When hiding a key, don?t make it easy for burglars to find it. It should be somewhere that you will easily remember where it is, even if you don?t use it until months or years later, but not some place too obvious where someone else could readily find it or come across it accidentally. Make sure when you do need to use it that you put it back right away, so you don?t forget.

1. Under the doormat -

The first place they look should be the last place you hide a key.? It?s been in too many movies.

2. Under a potted plant or planter-

- Yes, that?s the second place.

3. Mailbox or under a windowsill -

The mailbox is going to be looked in, some time or other, and nimble fingers will feel all along the house near the door, hoping you didn?t want to get your shoes wet if you lost your key on a rainy night.

4. Anywhere within ten feet of the door it opens -

Farther away than ten feet will give your own personal thief too much to do.? He?ll move on to easier pickings.

5. A faux rock (especially if it looks pretty fake, or you don?t have other rocks around in your yard) -

As a rule, do not buy anything that is sold for the purpose of hiding a key.? Burglars have seen all the commercials as well.? They?ve likely studied them.

These are common areas that burglars will check when attempting to break in. If one can be original in choosing a hiding place, then burglars will be less likely to find it.

Having a spare key hidden somewhere can save time and frustration, as long as you find a suitable hiding place. Keep it simple enough to remember, but difficult for others to guess. Check every so often to make sure the key is still there and in good shape. Then the next time you accidentally lock yourself out, you will be able to quickly get back in.

So much so that I bought my own cappuccino machine (from Starbucks of course), not content to have to get in my car to drive to my local coffee shop. I have other reasons too since I am very particular about using organic milk and just a little whip cream and cinnamon on top. I am not alone in this category, If you have ever been to a Starbucks you will know what I mean. Next time you are in line at Starbucks take a moment to listen to the requests customers are making about their drink preferences. The Barista?s at Starbucks have no qualms with this practice, in fact they pride themselves in making your beverage exactly as you wish, jotting notes on the cup to ensure your perfect drinking pleasure.

There is no doubt that coffee is a racket and the capitalists have figured out a way to turn a simple 95 cent beverage into a $4.00 indulgence. Starbucks is the leader in this category and Jeff Pierce recently asked me to review the astrology chart for the company after the stock made a significant pullback in July. We were looking for a good stock to add to our Astrology Traders weekend update and thought Starbucks might be good for a long term long position. Transiting Pluto will form a grand trine to Mars and Jupiter in the IPO chart suggesting a very strong bullish trend starting in mid November. The stock could have another?pullback into August 2nd?where there could be an opportunity to start scaling into the stock, however Jeff likes a long position near Friday?s close. Jeff and I both feel this is a long term hold opportunity.

Apple lists 8 Samsung products it wants banned

SAN FRANCISCO (AP) ? Apple Inc. on Monday gave a federal judge a list of eight Samsung Electronics Co. products it wants pulled from shelves and banned from the U.S. market, including popular Galaxy model smartphones.

U.S. District Judge Lucy Koh asked for the list after a jury in San Jose last week slammed Samsung with a $1.05 billion verdict, finding that the South Korean technology giant had "willfully" copied Apple's iPhone and iPad in creating and marketing the products. Samsung plans an appeal.

The products Apple wants out are all smartphones: Galaxy S 4G, Galaxy S2 AT&T, Galaxy S2, Galaxy S2 T-Mobile, Galaxy S2 Epic 4G, Galaxy S Showcase, Droid Charge and Galaxy Prevail.

Koh on June 26 banned the Galaxy Tab 10.1 from the U.S. market after finding it likely violated a "design patent." Samsung is now asking for that ban to be lifted after the jury found the computer tablet didn't infringe that particular patent, but it did find it infringed three Apple's software patents that cover the popular "bounce-back" and pinch-to-zoom features.

The judge has scheduled a Sept. 20 hearing to discuss Apple's demands for the sales bans. She asked Apple on Friday to submit the list of products its wants removed from U.S. stores after Samsung complained that it doesn't have enough time to prepare for the scheduled hearing.

The judge is deciding whether to reschedule the hearing to give Samsung more time to prepare. Samsung plans to ask the judge to toss out the jury's verdict as unsupported by the evidence. Failing that, the company says it will appeal the verdict to higher courts, including the U.S. Supreme Court.

In addition to the sales bans, Apple also plans to ask the judge to triple the damages to $3.15 billion because of the jury's finding that Samsung "willfully" copied Apple.

Apple filed its lawsuit in April of last year alleging that 28 Samsung smartphones and computer tablets had "slavishly copied" the iPhones and iPads. Samsung countered with its own claims that Apple used its wireless technology without proper compensation.

A nine-person jury in its verdict Friday unanimously agreed with Apple. Most of the damages were tied to Samsung's smartphones. The jury rejected Samsung's counterclaims.

Most of the Samsung products found to have "infringed' Apple's patent were older devices no longer being sold. The list Apple presented to the court on Monday represent devices it believes are still being sold in U.S. stores, including several versions of the company's popular S2 phones introduced last year. Samsung's newest and hottest selling smartphone, the Galaxy S3, was not part of the lawsuit and is unaffected by the jury's verdict.

The award represents about 1.5 percent of Samsung's annual revenue. Analysts said the embarrassment of the verdict is a bigger blow for Samsung than the financial setback.

Still, the question remains whether Samsung and other Apple competitors will have to redesign their smartphones to avoid infringing Apple's patents. Most analysts agree the verdict sends a threatening message to device makers such as Samsung, which use Google's Android operating system.

Hello all.? My name is Lorne Jaffe.? I?m a 38-year-old stay-at-home dad living in Douglaston, Queens, with my beautiful daughter, Sienna Giselle?born on 3/20/12, my incredible wife, Elaine, and our two cats, Gleeb and Minky.??I?ve also battled depression and anxiety most of life (including a severe 2010 nervous breakdown that left me out of work and on Social Security disability) both of which have raised their ugly heads all too often during my 5+ months of fatherhood.??My dream has always been to be a writer and for the longest time my brain would get in the way, but upon becoming a dad, I started posting Facebook (FB) updates about my life.??Out of desperate feelings of isolation and at the urging of friends, I joined the NYC Dads Meetup Group a few months ago.??To date I?ve only been to one meetup which while traumatic, was also very helpful in that I met and spoke deeply and received advice from a few other dads including Lance who suggested I become a guest blogger on the site?to share my unique experiences and add my voice to those of the active, caring, and involved father.?

Before I start writing fresh blog posts, we decided to share some of my past FB updates so you can see the ups and downs I?ve experienced since Sienna?s birth, and I felt what better way to start than to truly strip myself bare.? In May I posted an update after I, totally sleep-deprived, passed out on the couch with Sienna only to be awaken by her screams when she rolled off the couch.? I wrote about my failures as a stay-at-home dad, my guilt and terror, and my words drew the following response from someone I?d once considered a friend:

?

?I'm not one to give advice on how to be a good father since I have no kids of my own, but you need to man up. ?Your wife depends upon you looking after your daughter, there is no need to have a breakdown. ?Is it challenging, yes! ?But a challenge you should be capable of doing. ?So she cries, all babies do, you need to be the one with the level head to cope with this.??And reading how your daughter slipped off you was a classic Simpson's moment. ?Lol?

?

As you can imagine, I was extremely angry.? For once in my life I took power into my own hands, told the jerk to f**k off (and I rarely, rarely curse) and immediately unfriended him.? I then headed to what would be one of the worst therapy sessions I?d ever experienced (and my therapist is usually terrific and has helped me enormously).? A few days later, on May 23, 2012, I posted the following (abridged) update in which I wrote about living with depression and anxiety and which I think is the perfect way to really introduce myself to you:

?

?From my interactions w/ many of you, I've learned that some of you have suffered from depression and/or anxiety at some point in your lives. ?Some are in therapy; some have been in therapy. ?Like raising a child, some of you might not understand what depression is like if you haven't been through it. ?It's a very serious disease and its cause can be sociological, environmental, chemical, and/or genetic. ?Some people are prone to it. ?Some people develop it because of experiences. ?Sometimes it causes anxiety (which is a totally separate disease). ?Sometimes anxiety leads to depression. Sometimes anxiety doesn't even come into play. ?It knows no class, no race, no religion. ?And it is POWERFUL and DANGEROUS and SELFISH. ?I liken it to alcoholism in that you often wind up hurting the ones you love often w/out knowing you're doing it. ?In my case, I was probably prone to it and have brain chemistry issues. ?I know it runs in my family.? But I also had a boatload of terrible experiences.?

?

?I probably started developing it when I was around 4 when my sister was born and my father stopped showing me affection in favor of her. ?Before I go further, I've made adult peace w/ my dad and my mom and my sister, etc., but that wounded child still exists, unfortunately. ?The key is to not let it run me. ?When you suffer depression it's ALWAYS there and it's a constant battle not to give in.? You can catch yourself having irrational thoughts, but your emotions can overwhelm you like a tidal wave causing self-destruction. ?It's thoroughly exhausting. ?I often think of a quote from the old ?G.I. Joe? cartoon on which I grew up: ?Destroy the foundation, and the rest comes tumbling down.? ?That's true in physics, business, relationships, and mental health. ?But what if there's no foundation to destroy? ?What if it was never there?

?

?So anyway, the seeds were sown when I was very little. They were exacerbated by the P.S. 221 [my elementary school] gifted program where we were in such heavy competition with each other and where Mrs. Adelson [my 3rd?grade teacher] called me a failure and forced me to be retested to see if I even belonged.? That's the first mention of depression in my life...when I was 9. ?At the same time I was bullied in school and in camp, but I lacked the self-esteem to fight back because I was bullied at home as well. ?Sometimes bullies act the way they do because they lack self-esteem or because they're passing the torch. ?But not all of them. ?Not all homophobic people are closeted homosexuals. ?Some are just downright hateful.? I can't tell you which was which amongst the long line of bullies I've encountered. ?My dad, for instance, is an inherently good person, but just didn't know how to deal w/ a sensitive boy like me. ?He also used to be viciously sarcastic, probably as a defense mechanism. ?He's admitted to me that he felt his parents favored his sister and he has no idea why he then replayed that scenario w/ his own kids. I think he was just unable to break the cycle and my mom did not adequately protect me from him.

?

?So I lived to find affection SOMEWHERE, ANYWHERE. ?It's what made me the most loyal friend you could ever have, but also someone who was very often taken advantage of. ?Three years later I had Adelson again and it was a repeat, but this time was worse because now I'd developed gynecomastia...male breast enlargement. ?Understand that this affliction has nothing to do w/ weight. ?It hits 90-something percent of boys during puberty but disappears in 95 percent of cases according to studies. ?Mine didn't disappear and it only added to my lack of self-worth. ?Now I had to hide physically...baggy clothes, stooped shoulders, no more sports, no swimming w/out a shirt, no hope for a girlfriend. ?My parents unfortunately ignored the problem because my pediatrician said it would disappear if I lost weight. ?My dad was hard on me about this, and I felt he was embarrassed by me.

?

?So now I'm depressed, have a physical deformity ? an emasculating deformity of which I'm aware at all times ? and am getting bullied. ?[The gifted program at] P.S. 221 and my family are teaching me that success = money/job status. ?My dad becomes the very definition of work. ?He's a lawyer and so in my mind is successful. ?Nothing less than being a lawyer or a doctor is good enough, but I'm ?creative? and ?sensitive? and that's not my future. ?I don't fit into the world I've constructed. ?I also have no coping mechanisms and I've still yet to reach my ?formative? years.

?

?I'm not going to cite every example of bullying I've faced or take you step-by-step through H.S., college, and beyond. ?It's not worth it. ?I'll leave it for my memoir?if I ever write it. ?I will say anxiety probably entered my life in college. ?I suffered my first severe panic attack senior year and was taken to the hospital, my first nervous breakdown in 1996, and my second nervous breakdown in 2010.? I've come close to suicide on numerous occasions. ?Know that it has taken me 30-something years to even start to develop an ego. ?My deformity was finally corrected when I was 29, but like losing a limb, that phantom pain still exists (in my case, that phantom pain is emotional). ?Each and every day is a challenge. ?I'm still trying to learn how to build on things...what most people would call successes but in my twisted mind do not measure up.

?

?Do I realize that I'm lucky to have a loving wife, incredible friends, a caring family, and now a beautiful daughter? ?Yes. ?But too often those realizations are swallowed up by the tidal wave of irrational thoughts and emotions that come w/ depression and anxiety. ?That I stood up to that jerk is a huge, huge thing. ?I know that, but I needed it validated. ?I shouldn't have needed it, but I did. ?I admittedly write these updates not just for myself, but to hear your stories so I learn that I'm not alone. ?I'm writing this update to educate those of you who have never suffered depression and/or anxiety on what it's like and to tell those of you that have that you're not alone and you have nothing to feel ashamed of.

?

?I'm scared as hell when it comes to raising Sienna and being a stay-at-home dad. ?I'm constantly battling thoughts that I've failed when it comes to work. ?Your comments and support have been an ENORMOUS help. ?My ego is still forming. ?I have grown significantly since my last breakdown. ?I recognize that. ?I also recognize the guts it takes for me to do these updates and lay myself bare. ?But every day remains a battle and some days I lose. ?I consider you all my friends and I am there if you need me. ?I hope you feel the same. ?I needed to get this out of my system. ?It's written down now in black and white. ?If you don't accept me, like that jerk, then you're not my friend. ?If you do, I love you for it. ?And by the way, this morning, Sienna was crying. ?I opened the door to the her room and w/out provocation...without me changing facial expressions or saying a word...Sienna smiled at me and it warmed my heart.??

  • You must clear all Content, Third-Party Data, and any other stored sensitive or personal information stored on your Wii Console prior to selling or otherwise transferring your Wii Console. If you acquire a used Wii Console, you must clear, and may not use, any of this data if still on the Wii Console when you acquire it.
  • The Wii Network Service is licensed to you for use on your Wii Console only in the United States, Canada, or Latin America.

Chapter II: Unauthorized Software, Services, or Devices or Unlicensed Accessories

    Your Wii Console and the Wii Network Service are not designed for use with unauthorized software, services, or devices or non-licensed accessories, and you may not use any of these with your Wii Console or the Wii Network Service. Such use may be illegal, voids any warranty, and is a breach of this agreement. Such use may also lead to injury to you or others or cause performance issues or damage to your Wii Console or the Wii Network Service. We (and our licensees and distributors) are not responsible for damage or loss caused by unauthorized software, services or devices or non-licensed accessories. We may take steps to disable or delete any unauthorized software, services or device installed in your Wii Console, for example, by detecting and disabling them through the Wii Network Service and/or game software. If we detect unauthorized software, services, or devices, your access to the Wii Network Service may be disabled and/or the Wii Console or games may be unplayable.

Chapter III: Updates/Changes

    You understand that the Wii Console specifications and the Wii Network Service are constantly evolving and that we may update or change your Wii Console or the Wii Network Service in whole or in part, without notice to you. Such updates may be required for you to play new Wii games or continue to access the Wii Network Service. We may also upgrade, change, or terminate the Content or game software or may discontinue offering Products without notice to you.

Chapter IV: Wii Shop

Article 1: Wii Shop Account

    You must create a Wii Shop Account to use the Wii Shop. A Wii Shop Account is personal to you. You are responsible for monitoring use of, and limiting access to, your Wii Shop Account and for anyone using your Wii Shop Account, even without your permission.

Article 2: Points

    The Wii Shop allows you to use Points to download a license to use Content or purchase Products (and may also allow you to do such things as download licenses to use certain Content for free, or use your Points to send Content to a friend). Points are primarily intended for the purchase of downloadable video game content, and are taxed accordingly. Points are not your personal property. Points have no cash or monetary value and are non-refundable.

    Once you place Points into your Wii Shop Account, you may not withdraw, sell, or transfer them to another. You are responsible for your or anyone else's use of Points in your Wii Shop Account, even if you did not give them permission to use those Points.

    If we suspect fraudulent or unlawful activity concerning your Wii Shop Account or your use of Points, we may cancel, suspend, or otherwise limit your access to all or part of the Wii Network Service. If, as a result, your Wii Shop Account or your Points are deleted, they will be reinstated at our sole discretion.

Article 3: Credit-Card Charges and Your Billing Account

    You may use your credit card to purchase Points through the Wii Shop. If you use a credit card, you represent that you are authorized to do so and you agree that you are responsible for all charges to that credit card. Unless otherwise required by law, charges to the credit card to purchase Points are nonrefundable.

Article 4: Account History

    Each time you purchase Points through the Wii Shop, and each time you use Points to license Content or purchase Products, the transaction will be reflected in your account history. Account-history information for each transaction will be available for at least one year through the Wii Shop.

Chapter V: Third-Party Data

We are not responsible for any Third-Party Data or for any action you may take relating thereto (including but not limited to modifying, distributing, or posting Third-Party Data). All Third-Party Data is the sole responsibility of the creator or sender of that Third-Party Data. Although we may choose to do so, we are not obligated to monitor, supervise, store, or maintain Third-Party Data or respond to complaints relating to Third-Party Data.

If legally permitted, we may access, use, and disclose any Third-Party Data in order to protect our rights or property, to protect other users of the Wii Network Service, or to comply with legal requirements such as a lawful subpoena. You understand that you have no expectation of privacy in anything you receive or transmit via the Wii Network Service.

Chapter VI: Other

Article 1: Third-Party Providers

    We may use third parties to provide any portion of the Wii Network Service. We may offer third party services or material to you (including Content and Products) through the Wii Network Service, so you may use Points to purchase from us a license to use such Content or to get Product. We may also allow third parties to directly provide Third-Party Data to you through the Wii Network Service.

Article 2: Intellectual Property

    We own all right, title and interest in, or have the right to distribute, use or sublicense, the Wii Network Service and the Nintendo IP. We do not provide you with any interest in the Wii Network Service or the Nintendo IP. Except as expressly authorized by us in writing, you may not create works based on the Wii Network Service or the Nintendo IP or modify, distribute, or transmit the Nintendo IP. If you do not abide by these requirements, Nintendo shall own all right, title, and interest in any works created, adapted, distributed, or transmitted via the Wii Network Service, or, in the alternative, an unlimited license thereto.

    We respect the intellectual property of others. If you believe that any material within the Wii Console infringes upon any intellectual property right which you own or control, you may file a notice of such infringement with us, as provided in Article 15. Our entire Intellectual Property Policy may be viewed at www.nintendo.com/ippolicy.

Article 3: Hosting, Intercepting, Emulating, and Reverse-Engineering Prohibited

    You may not host, intercept, emulate, or reverse engineer any part of the Wii Console or the Wii Network Service.

Article 4: Parental Controls Function

    You may limit access to certain features of the Wii Console and the Wii Network Service through our parental controls function; however, you are responsible for any features or material that anyone accesses through your Wii Console even if you use the parental controls function.

Article 5: Code of Conduct

    Your use of the Wii Network Service is subject to the Wii Code of Conduct, which prohibits all harmful, illegal or otherwise offensive conduct. The most current version of the Wii Code of Conduct, which may be revised by us from time to time, is posted at http://support.nintendo.com. You may also contact our customer-service department, and we will mail you the current version, free of charge.

Article 6: Submissions

    Please do not send us any creative or original materials such as ideas for toys, games, or other products, or any creative suggestions, ideas, notes, drawings, concepts, or other information through the Wii Network Service or otherwise. Any unsolicited submissions become our sole and exclusive property and may be used by us with no obligation of confidentiality, payment, or attribution.

Article 7: Protection of Personal Information

    We are committed to protecting the privacy and security of your personal information. Your use of the Wii Network Service is subject to the Wii Privacy Policy, which applies to information submitted or collected through the Wii Network Service. The most current version of the Wii Privacy Policy, which may be revised by us from time to time, is posted at http://support.nintendo.com. You may also contact our customer-service department, and we will mail you the current version, free of charge.

Article 8: Warranties

    ALTHOUGH WE STAND BEHIND OUR SERVICE, CONTENT AND PRODUCTS, WE AND OUR LICENSEES, LICENSORS AND SUPPLIERS ARE PROVIDING THE Wii NETWORK SERVICE "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND (INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE), TO THE MAXIMUM EXTENT PERMITTED BY LAW. USE OF THE Wii NETWORK SERVICE IS AT YOUR SOLE RISK. THIS MEANS, FOR EXAMPLE, THAT WE DO NOT GUARANTEE THAT THE Wii NETWORK SERVICE WILL ALWAYS WORK PROPERLY. THIS ALSO MEANS WE DO NOT GUARANTEE THAT THE Wii NETWORK SERVICE, CONTENT OR PRODUCTS WILL BE FREE FROM VIRUSES, HACKS, OR OTHER POTENTIALLY HARMFUL INTRUSIONS. PLEASE NOTE THAT SOME STATES DO NOT ALLOW SUCH WARRANTY LIMITATIONS, SO THESE LIMITATIONS MAY NOT APPLY TO YOU. PLEASE SEE THE Wii OPERATIONS MANUAL FOR ANY WARRANTIES THAT APPLY TO THE Wii CONSOLE.

Article 9: Limitation on Claims

    If you think you have a claim against us related to the Wii Console or the Wii Network Service, you must take legal action within one year after the date of the alleged incident. After the one-year period expires, you may never raise that claim.

Article 10: Change, Suspension or Discontinuance of Wii Network Service

    We may change, suspend, or discontinue the Wii Network Service, or any feature or aspect of the Wii Network Service, at any time, with or without notice to you, and without liability to us. This includes, but is not limited to, the availability of all or any portion of the Wii Network Service, Content, Products, Points, and the number of Points required to redeem particular Content or Products.

Article 11: Limited Responsibilities and Indemnification

    You agree to waive any and all rights to claim damages or losses caused to you or relating to your inability to use the Wii Network Service (or to anyone else using the Wii Network Service through your Wii Console). You understand you might never be fully compensated for that damage or loss if we or one of our licensees, licensors or suppliers (collectively referred to in this Article 11 as "we" or "us") somehow harm you. This is because we limit our liability to you (and to others) in several ways:

  • Your ability to recover damages or losses from us is limited: you may recover only direct damages, up to the total amount you have ever paid for Points. Generally, direct damages are losses you (or anyone else) suffer as the immediate result of something someone has done wrong.
  • You may not recover any other types of damages, no matter the reason. For example, sometimes a court will award a special amount of damages to punish the person at fault, or, a person might have to pay for damages where the person did not directly cause harm. You agree that we will never have to pay punitive, special, consequential, or incidental damages to you.
  • We are also not liable to anyone else, or for the actions or inactions of anyone else. For example, if your friend is somehow harmed using the Wii Network Service or the Wii Console, we are not responsible to you, your friend, or anyone else. If another person somehow harms you while using your Wii Console or Wii Network Service, we are not liable to you for that other person's actions.
  • These limitations on liability apply to all matters relating to the Wii Network Service and the Wii Console, including your use of the Wii Network Service and your use of Content or Products that do not specify other limitations on liability. These limitations also apply to any legal or equitable theory, including but not limited to breach of contract, breach of warranty, strict liability, negligence, or other tort. Please note, however, that some states or provinces do not permit certain limitations like these, so these limits on other damages may not fully apply to you.

    If you breach this agreement, and we or another company or person is harmed by your breach, then you must indemnify us (and our licensees, licensors, and suppliers and any of our employees) from all of the losses and costs related to your breach, including our attorneys' fees. You must also indemnify us for any claims relating to Third-Party Data modified, created, or sent by you.

Article 12: Expiration and Termination of Agreement

  • You may cancel your Wii Shop Account by contacting our customer-service department or by following the instructions in the Wii Shop. If your Wii Shop Account is canceled or terminated for any reason, you will no longer be able to use the Wii Shop. You will lose all downloaded Content and forfeit any rights to any unused Points, which become our property.
  • You may terminate this agreement by removing Content from your Wii Console, discontinuing use of the Wii Network Service, and forfeiting any rights to Points in your Wii Shop Account, which become our property.
  • We may terminate this agreement, or any portion thereof, at any time, for any reason whatsoever. Such termination will void any licenses granted in accordance with this agreement and may prevent your use of the Wii Network Service.
  • We have no obligation to return or refund Points to you, even if the agreement ends.
  • In the event this agreement is terminated or canceled, the following sections will remain in effect: Unauthorized Software, Services, or Devices or Unlicensed Accessories; Credit-Card Charges and Your Billing Account; Intellectual Property; Hosting, Intercepting, Emulating, and Reverse-Engineering Prohibited; Submissions; Warranties; Limitation on Claims; Limited Responsibilities and Indemnification; Expiration and Termination of Agreement; Governing Law, Legal Jurisdiction, and Interpretation of Agreement.

Article 13: Current Agreement and Update

    We may change the terms and conditions of this agreement, the Wii Code of Conduct, or the Wii Privacy Policy, at any time. A current version of this agreement will be available on the Internet at http://support.nintendo.com. If you do not have Internet access, you may contact our customer-service department, and we will mail you a current version of this agreement, free of charge. We will post notice on http://support.nintendo.com if the agreement is changed at least 5 days before the changes become legally binding. If you do not agree to these changes, you must cancel your Wii Network Service in accordance with this agreement. If you do not have Internet access, you should periodically contact our customer-service department and ask whether there have been any changes to the agreement since the last version you obtained.

Article 14: Sale, Transfer and Assignment Prohibited

    You may not assign all or any part of this agreement or sell or transfer any Content or your Wii Shop Account to any third party. Any attempt by you to do so is void.

Article 16: Governing Law, Legal Jurisdiction, and Interpretation of Agreement

    This agreement and any claims arising under it is governed by the laws of the state of Washington, without reference to conflict of laws principles. If you want to sue us with respect to a claim related to this agreement, your lawsuit must be brought in King County, Washington, and you consent to the jurisdiction of courts located there. You agree that if any part of this agreement is determined to be invalid or unenforceable, that part will no longer apply and will be considered deleted from the agreement, but all other parts of the agreement will remain in effect. You further agree that we may replace the invalid part by a provision which reflects or comes closest to reflecting the initial intention. If we choose not to enforce a provision of the agreement, you agree that we are not waiving our right to do so in the future.

Article 17: Definitions

    "Content" means the software, services, material and other data which we own or have the right to use, distribute or sublicense, and which we send to, or make available as a download through, the Wii Console or the Wii Network Service.

    "My Nintendo" means the loyalty program offered by Nintendo.

    "Nintendo IP" means all intellectual property, including but not limited to trademarks, copyrights, moral rights, inventions, patents, trade secrets, know-how and other confidential and proprietary information which we developed, own or have a license to use.

    "Points" means the points that you purchase from us through the Wii Shop or through points cards sold or distributed by us or our retailers and promotional partners and that you may exchange with us for a license to download Content or to purchase Products.

    "Products" means any goods other than Content that are made available for purchase from us through the Wii Shop.

    "Third-Party Data" means Content or other software, services, material, messages (including commercial and non-commercial messages), links to Internet sites, and other data either created by, or sent to, your Wii Console through the Wii Network Service by any non-Nintendo entity or person (including you).

    "Wii Console" means Nintendo's system (including the Wii Remote) sold and marketed by Nintendo under the Wii brand, including any succeeding systems and compatible systems.

    "Wii Network Service" means the service whereby we can distribute Content, messages (including commercial and non-commercial messages) and other data to your Wii Console, or link you to an Internet site, and whereby you can send and receive Content, messages (including commercial and non-commercial messages), and other data, including Third-Party Data, using your Wii Console. The "Wii Network Service" includes, but is not limited to, the Wii Shop.

    "Wii Shop Account" means an account on your Wii Console which you set up and use in connection with the Wii Shop.

    "Wii Shop" means our online Wii Console's store, which offers such things as Points, Content, Products, and a download service, all of which Nintendo directly or indirectly operates.

A n?Maps Lifetime subscription entitles you to receive up to four (4) map data updates per year, when and as such updates are made available on Garmin's website, for one (1) compatible Garmin product until your product's useful life expires or Garmin no longer receives map data from its third party supplier, whichever is shorter. Your n?Maps Lifetime subscription may not be transferred to another person or another Garmin product. A n?Maps Onetime purchase entitles you to receive one (1) map data update for one (1) compatible Garmin product. The update(s) you receive under the n?Maps Lifetime subscription or n?Maps Onetime purchase (as applicable) will be update(s) to the same geographic map data originally included with your Garmin product when originally purchased. In some instances, your Garmin product might not have sufficient memory remaining for you to load an update to the same map data originally included with your Garmin product, in which case you will need to either (a) select reduced map data coverage for your update(s), or (b) purchase separately a microSD card or a SD card (as applicable to your Garmin product) and load all or a portion of the map data coverage for your update(s) to the card and insert the card into the SD card or microSD card slot contained in your Garmin product.

  1. Scope
    1. These Terms and Conditions shall apply to all purchase orders submitted or to be submitted by you for any item, service or subscription offered to you on or via the TomTom website or TomTom HOME, a TomTom device or other TomTom application (referred to in these Terms and Conditions as the "Products"), including, but not limited to, (i) hardware devices, accompanying items and accessories including devices, items or accessories containing pre-installed software ("Hardware") and (ii) services offered by TomTom from time to time ("Services"), which may include (separately or bundled. Internet-based services or location based services, data services, real time information services such as traffic information and weather forecasts, or the provision of other data, information, (third party) functionality or content, whether offered to you on a subscription basis ("Subscription") or on a pre-paid basis and delivered in one or more parts.
  2. Orders
    1. Any purchase order submitted is subject to acceptance by TomTom. Only upon acceptance by TomTom by way of an order confirmation is the agreement concluded.
    2. TomTom reserves the right to reject any orders in full or in part or to apply a maximum order amount.
    3. c. All orders for Hardware are subject to stock availability.
  3. Price and payment
    1. Prices indicated on the website are exclusive of state and local sales and use taxes. You are responsible for any such state and local sales and use taxes, and any other taxes and government levies, if any, associated with your order. If state and local sales and use taxes are due, these amounts will be added to the sale price and your payment will be inclusive of those amounts. Shipping and handling charges (if any) will apply in addition to the sale price indicated on the website and the applicable sales and use taxes.     3. If, for whichever reason, collection through the Payment Service should fail, TomTom will invoice you by post for the amount payable, which must be paid by check, postal order or credit card within fifteen (15) days from the date of invoice.
  4. Delivery and risk of loss
    1. TomTom will endeavor to deliver or activate the Product within thirty (30) days of order acceptance. If multiple Products are ordered, TomTom reserves the right to deliver or activate each Product separately.
    2. Products will be delivered either to your delivery address or possession, or electronically. The risk of loss or damage to the Products will pass to you at the moment the Products are delivered to your delivery address or possession.
    3. If you refuse or neglect to take delivery of the Products, TomTom reserves the right to charge you for the reasonable cost of storing the Products until delivery can be made.
    4. If delivery to you should fail for any reason outside of TomTom's control, TomTom reserves the right to cancel the purchase agreement and refund any monies paid.
    5. If TomTom delivers a Product or an amount of a Product that you did not order or activates a Product on your device by mistake, you shall immediately inform TomTom of its mistake by email via www.tomtom.com/support and you shall, at TomTom's request, immediately arrange for the return of the Product (the costs of which shall be met by TomTom), de-install or destruct the Product.
    6. Acceptance of a non-ordered Product or amount of a Product does not relieve you from acceptance and payment of the Product you initially ordered, unless otherwise agreed with TomTom.
  5. Return Policy
    1. TomTom allows you to return Hardware for any reason provided that it has not yet been used at any time during the fourteen (14) business days following the date of receipt at your delivery address. If the item has not been opened, TomTom will refund the purchase price actually paid minus shipping and handling charges. If the item has been opened, TomTom will charge a 15% restocking fee in addition to shipping and handling charges. TomTom will not issue refunds for products that have been defaced, altered, used, or damaged in any way. All requests for refunds are subject to inspection by TomTom of the returned item. TomTom will issue refunds by issuing a credit to the credit card used to purchase the item. If you choose to return any Hardware, you must contact TomTom during the fourteen (14) business days following receipt by email via www.tomtom.com/support to obtain a Return Materials Authorization number and return the Hardware in its original packaging, free of all interests, liens, or claims otherwise, to the address provided by TomTom. TomTom will not issue any refunds in response to requests made more than fourteen (14) business days following receipt of the item. Items cannot be returned to a retail store. TomTom will only accept returns on items purchased directly from the TomTom store.
    2. Purchases of Software may be cancelled in accordance with clause 5(a. provided that the seal has not been broken. Downloading, installing or activating Software are all considered as breaking the seal.
    3. You agree that the supply of Services by TomTom will commence immediately on TomTom's acceptance of your purchase order. You will not be able to cancel the purchase agreement after supply of the Services commences, unless TomTom fails to provide the Services with reasonable care and skill.
    4. All sales of products sold as Refurbished or Road Tested are final.
  6. License, Copyright & Confidentiality
    1. Subject to these Terms and Conditions, you are granted a license to reproduce in order to install and execute the Software and/or the data, information, functionality or other content ("Content") provided to you as part of the Hardware or via for personal and private use only on the terms set out in this article 6 ("License"). You may install and use the Software and Content on only one computer device at any time and in combination with only one navigation system. You may not provide the Software or Content to others, directly or indirectly for their or anyone else's use. This License is non-exclusive and non-transferable which means that TomTom is free to license the Software and Content to other customers and that your right to use the Software and Content cannot be transferred by you to someone else or to another piece of Hardware. This License does not include any right to obtain future upgrades, updates or supplements to the Software or Content, unless TomTom has specifically indicated that obtaining such updates, upgrades or supplements is an integral part of the Product. If upgrades, updates or supplements to the Software or Content are obtained, however, the use of such upgrades, updates or supplements will be governed by these Terms and Conditions or such other terms and conditions as you shall be asked to accept prior to TomTom supplying you with the relevant upgrade, update or supplement.
    2. TomTom reserves the right, with or without notice, to discontinue update upgrade and supplement services provided to you or made available to you through the use of the Software or Content, unless the provision of such updates, upgrades or supplements forms an integral part of the Product, as indicated by TomTom at the time of sale.
    3. Without prejudice to any other rights, TomTom may immediately terminate the License without notice of default being required if you fail to comply with any material term of these Terms and Conditions which shall be understood to include clauses 6 and 9. In such event, you must destroy all copies of the Software and all of its component parts as well as any Content.
    4. Copyright and other intellectual, industrial and/or proprietary rights to the Software, to the Content, and to any copies made of it are owned by TomTom and/or its suppliers. TomTom permits you to use the Software and Content only in accordance with these Terms and Conditions. All rights not specifically granted in these Terms and Conditions are reserved by TomTom. You may either (a. make one copy of the Software solely for backup or archival purposes, or (b. transfer the Software to a single medium provided the original is kept solely for backup or archival purposes. Product manual(s) or written materials may not be copied, except for your own use. You may not copy, download, upload or in any other way reproduce Content, except for creating one copy solely for backup or archival purposes. You do not acquire ownership of the Software or Content.
    5. You acknowledge and agree that the Products were developed at considerable time and expense by TomTom and are confidential to, and a trade secret of, TomTom and/or other third parties. You undertake to maintain the Products in strict confidence and not to disclose or provide access to the Product to any third party.
  7. Subscriptions
    1. Subscriptions will be entered into for an indefinite period of time, unless TomTom and you have agreed on a fixed period of time.
    2. If your Subscription is for an indefinite period of time, either you or TomTom may terminate your Subscription by taking a notice period into account of 30 days (your notice to be sent: by e-mail via www.tomtom.com/support. This notice period starts on the first collection date after receipt of your notice of termination by TomTom. If your Subscription is for a fixed period of time, it will automatically end upon expiration of such period of time.
    3. TomTom reserves the right to change the prices for or the terms and conditions applicable to your Subscription, subject to giving you prior notice thereof (either via email, the TomTom website or otherwise.. If such change will result in higher prices or otherwise works towards your disadvantage (but not in case the higher prices result from higher government levies or taxes), you may terminate your Subscription prior to and against the date such change comes into effect by sending an e-mail via www.tomtom.com/support.
    4. TomTom may terminate your Subscription as per the end of a calendar month by providing at least 30 days prior notice if TomTom decides to discontinue offering such Subscription.
    5. TomTom may terminate your Subscription with immediate effect without notice of default being required if (i) you fail to comply with any material term of these Terms and Conditions which shall be understood to include clauses 6 and 9 or (ii) collection through the Payment Service for Subscriptions should fail after a second attempt.
    6. Upon termination of your Subscription, your License as detailed in clause 6 will terminate simultaneously.
  8. Third Party Software Materials
    • TomTom Products may make use of third party software codes, data, information functionality, other content and algorithms ("Third Party Materials"). The use of Third Party Materials included in the Products may be subject to other terms and conditions. The official copyright notices and specific license conditions of these Third Party Materials are to be found in or via our website www.tomtom.com/legal. You hereby agree that the submission of any order implies that you have read and accepted the terms and conditions for any Third Party Materials included in the Products ordered.
  9. Other Restrictions
    • Renting, lending, public presentation, performance or broadcasting or any other kind of distribution of the Products is prohibited. Other than as permitted by applicable legislation, you will not, and will not allow any person to, modify the Products or any part thereof, to analyze it by means of reverse engineering, to decompile or disassemble the Products, or to break or circumvent encryption or to allow or enable third parties to do so.
  10. Limited Warranty
    1. TomTom does not and cannot warrant that the Products operate in a manner that is completely error-free nor that any information provided is always accurate. Calculation errors may occur when using navigation systems such as those caused by local environmental conditions and/or incomplete or incorrect data.
    2. TomTom offers a limited warranty that the Hardware will be free from defects in workmanship and materials under normal use ("Defects") for a period of one (1. year from the date the Hardware was purchased ("Warranty Period"). Any warranty obligation of TomTom under this Section is expressly conditioned on your compliance with this Agreement. During the Warranty Period, the Hardware will be repaired or replaced by TomTom ("Limited Warranty") without charge for either parts or labor. If the Hardware is repaired after the Warranty Period has expired, the Warranty Period for the repair will expire six (6) months after the date of repair. This warranty does not cover Services.
    3. This Limited Warranty does not cover damage caused by normal wear and tear or as a result of the Hardware being opened or repaired by someone not authorized by TomTom, and does not cover damage caused by: misuse, moisture, liquids, proximity or exposure to heat and accident, abuse, non-compliance with the instructions supplied with the Hardware, neglect or misapplication. The Limited Warranty does not cover physical damage to the surface of the Hardware.
    4. EXCEPT FOR THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOMTOM AND ITS SUPPLIERS PROVIDE THE PRODUCTS "AS IS AND WITH ALL FAULTS", AND HEREBY DISCLAIM ALL OTHER WARRANTIES AND CONDITIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY (IF ANY) IMPLIED WARRANTIES, DUTIES OR CONDITIONS OF MERCHANTABILITY, NON-INFRINGEMENT, QUIET ENJOYMENT, SYSTEM INTEGRATION, TITLE, SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF RELIABILITY OR AVAILABILITY, OF ACCURACY OR COMPLETENESS OF RESPONSES, OF RESULTS, OF WORKMANLIKE EFFORT, OF LACK OF VIRUSES, AND OF REASONABLE CARE AND SKILL, ALL WITH REGARD TO THE PRODUCTS, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT OR OTHER SERVICES, INFORMATION, SOFTWARE, AND RELATED CONTENT THROUGH THE PRODUCTS OR OTHERWISE ARISING OUT OF THE USE OF THE PRODUCTS. ALSO, THERE IS NO WARRANTY OR CONDITION OF QUIET ENJOYMENT, QUIET POSSESSION, OR NON-INFRINGEMENT WITH REGARD TO THE PRODUCTS.
    5. In order to make a claim under the Limited Warranty of a Defect, you must contact TomTom by email during the Warranty Period via www.tomtom.com/support to explain the Defect and to obtain a Return Materials Authorization number if necessary. The Software or Hardware must be returned to TomTom as soon as possible following your notification of the Defect, along with an explanation of the Defect, to the address provided by TomTom. You must comply with any other return procedures stipulated by TomTom, if any.
    6. This Limited Warranty is the only express warranty made to you and is provided in place of any other express warranties or similar obligations (if any) created by any advertising, documentation, packaging, or other communications.
    7. If applicable law requires any implied warranties with respect to the Hardware, all such warranties are limited in duration to one (1. years. Some states and/or jurisdictions do not allow limitations on how long an implied warranty lasts, so the above may not apply to you. The provisions of this clause 10 do not affect any of your legal rights under applicable national legislation governing the sale of consumer goods.
    8. This Limited Warranty is not transferable.
    9. This clause 9 sets forth your sole and exclusive remedy in connection with any warranties granted by TomTom hereunder.
      Some jurisdictions do not allow limitations on how long an implied warranty lasts and/or do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction.
  11. Limitation of Liability
    1. NEITHER TOMTOM NOR ITS SUPPLIERS SHALL BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES (INCLUDING IN EACH CASE, BUT NOT LIMITED TO, DAMAGES FOR THE INABILITY TO USE OR ACCESS THE PRODUCTS, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION OR THE LIKe. ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCTS, EVEN IF TOMTOM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
    2. NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED HEREIN AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT OR ANYTHING ELSe., THE ENTIRE LIABILITY OF TOMTOM AND ANY OF ITS SUPPLIERS ARISING FROM OR RELATED TO THE USE OF THE PRODUCTS SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE PRODUCTS CONCERNED.
    3. Notwithstanding articles 11(a. and (b.,or anything else contained in these Terms and Conditions neither party's liability for death or personal injury resulting from its own negligence shall be limited.
    4. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. The above limitation of liability does not affect any legal rights under the applicable national legislation.
  12. Export Controls
    • You will comply with all applicable laws and regulations, including without limitation the U.S. Export Administration Act, regarding the export of technology with respect to the Products.
  13. Force Majeure
    • Force majeure means circumstances that impede the fulfillment of TomTom's obligations under these Terms and Conditions which are not within TomTom's reasonable control, including late and/or delayed deliveries and incomplete deliveries by TomTom caused by circumstances beyond TomTom's reasonable control. In a force majeure situation all of TomTom's obligations shall be suspended. Should the period in which TomTom cannot fulfill its obligations as a result of force majeure continue for longer than ninety (90) calendar days, both parties shall be entitled to dissolve the purchase agreement in writing without there being an obligation to pay any compensation whatsoever arising out of or in connection with that dissolution.
  14. Privacy
    • TomTom will not disclose information regarding your personal details, account or transactions to any third party other than in accordance with its Privacy Policy, as indicated on the website www.tomtom.com/legal. You hereby agree that you have read and accepted the Privacy Policy.
  15. Links to Third Party Websites
    • TomTom is not responsible for the content of any third-party websites or services, any links contained in third-party websites or services, or any changes or updates to third-party websites or services. Where TomTom provides links and/or access to third-party websites and/or services it is only as a convenience to you, and the inclusion of any link or access does not imply an endorsement by TomTom of the third-party site or service.
  16. Third Party Rights
    • Third parties have no rights under applicable legislation in relation to the rights of third parties to rely upon or to enforce any term of these Terms and Conditions but that does not affect any right or remedy of a third party which exists or is available apart from such applicable legislation.
  17. Survival
    • Any provisions in these Terms and Conditions which by their nature extend beyond the termination or expiration of any sale or license of the Products will remain in effect.
  18. Severability
    • If any provision of these Terms and Conditions is deemed to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect. You and TomTom are deemed to have agreed to new terms and conditions in substitution for such invalid provisions. These new terms and conditions shall be interpreted, as regards their contents and effect, as closely as possible to the original text as written but in such a way that rights can indeed be derived from them.
  19. Governing law
    • These Terms and Conditions and any disputes related to these Terms and Conditions or to the purchase and use of the Products or otherwise are subject to the laws of Massachusetts. The United Nations Convention on Contracts for the International Sales of Goods is hereby excluded from application to these Terms and Conditions. All disputes arising out of these Terms and Conditions shall be settled by the courts of Boston, which will have exclusive jurisdiction in respect of any such disputes.
  20. Translations
    • This English version of these Terms and Conditions is the version that governs your purchase, of Products from TomTom if you are located in the Unites States of America.
