USA News Biz: Lone Star and KEB: It's Not Over Yet

If you thought you'd heard the last of the Lone Star Funds saga in South Korea, think again.

On Tuesday, the Dallas-based private-equity firm, which has been trying to offload the stake in Korea Exchange Bank it bought in 2003, said it is considering filing arbitration claims against the Korean government for damages over its unwillingness to approve a number of prospective buyers for KEB. Lone Star alleges that by thwarting these attempts to sell, the government forced it to hold the stake for longer than necessary and incurred losses along the way.

Seoul's financial regulator finally gave the go-ahead in January to Hana Financial Group Inc. to buy a 51.02% stake in KEB for $3.5 billion from Lone Star. Lone Star bought a 64.6% stake in KEB in 2003 for 2.155 trillion won ($1.9 billion). Lone Star's exit was hobbled by ongoing disagreement over the sale price and a legal probe in October that found Lone Star guilty of stock manipulation. That put pressure on Hana to cut the price it would pay to Lone Star, to placate lawmakers and labor union members who felt the firm had reaped unfairly large gains.

Another sticking point is over Seoul's decision to impose capital gains taxes on the sales of its Korean investments. Lone Star, which had been holding the investment in KEB in a Belgian vehicle, has opposed the decision by the National Tax Service because of a tax treaty between Korea and Belgium. Lone Star and the tax authorities were involved in a number of legal disputes in 2007 over the tax agency's attempts to impose back taxes on property sales by the fund.

In a statement, John Grayken, chairman of Lone Star, said, "When Lone Star made these investments, we were optimistic about Korea's ability to recover from the shock of the 1997-98 Asian financial crisis and believed we could rely on the Korean regulatory and tax laws to protect our interests in these investments. However, as the economy strengthened and Korean banks and businesses, including many foreign-owned banks like KEB, returned to profitability, public sentiment towards foreign investment in Korea soured. Korean financial and tax regulators responded with a series of illegal actions that resulted in billions of euros of damages to Lone Star's investors."

The news comes after the Korean government recently suggested it would adopt a more open stance to foreign investors as it tries for the third time to privatize Woori Finance Holdings, the country's largest financial company. Only Standard Chartered has a meaningful presence in the country, and HSBC also recently bowed out of retail banking there to concentrate on corporate banking.

Whether foreign investors want to rethink Korea's finance industry may well hinge on how this latest tussle between Lone Star and the country's regulators pan out.

Pete Tong Readies First-Ever 'Rocktronic' Ibiza123 Festival For July

EDM tastemaker tells MTV News he'll pair dance and rock acts like Lenny Kravitz and Luciano at the event.

For more than two decades, Pete Tong's "Essential Mix" radio show has been heralded as an authority in electronic dance music. BBC Radio 1's legendary tastemaker had his finger on the pulse back when just a few underground acts were thriving and he has maintained his impact in an era when EDM has become a global phenomenon.

Now, with mainstream artists like Flo Rida sampling the likes of Avicii, Tong is gearing up to launch an event that will pair dance DJs with rock stars. The Ibiza123 Festival will kick off in July on the Spanish island. And while Ibiza is essentially the genre's mecca, Tong saw a void there.

"Strangely, in Ibiza club history there has never been a festival," he told MTV News recently. "The concept is to allow the DJs to do something at the festival that they don't do on their own gigs at the clubs: so we've come up with this 'Rocktronic' idea of actually pairing up electronic artists with legendary stars from the world of rock and roll.

"On the first day, it's going to be Sting with the Basement Jaxx," he continued. "On the second day, it's Elton John with [Australian duo] Pnau. And on the third day, it's Lenny Kravitz with Luciano. And then Axwell is playing at it, David Guetta, Tiësto, Tinie Tempah, Labrinth."

While Ibiza has always laid out the welcome mat for EDM stars, the U.S. was a little slower to catch on. In fact, when MTV News first caught up with Tong last year, he was still marveling at the Stateside rise of dance music.

"I've been around a long time, and I've seen America flirt with dance music before," Tong told us during 2011's Miami Music Week. "Back in the days when the Prodigy had broken out and it was straight on to Lollapalooza. Everyone was getting really, really excited, [but] the thing about that is everyone got excited on a festival level, and it never really leaked down into the roots of society, whereas it definitely has more of a hold now."

One year later, Afrojack, Avicii, Kaskade and Porter Robinson have embarked on full-scale American tours. Rap mogul Jay-Z announced last week that he has tapped Calvin Harris, Afrojack and Skrillex to join him at his two-day Made in America Fest in Philadelphia. And virtually every major festival set to go down on these shores this summer and fall boasts an EDM roster. Even Tong is quick to point out he didn't see this dramatic swell in popularity coming.

"As we sat here a year ago, I was sitting here talking about the whole thing exploding, and America getting it more and more. And I think if we'd sat here predicting how big it would be 12 months later, I would have undersold it," Tong admitted. "I think it's just crazy now how big it is. It's like the country is lapping it up."

With support from the local government, Tong said there are already plans to host Ibiza123 annually, from July 1 to July 3; a brand-new site is under construction in San Antonio with a stage that will back out into the sea.

"You'll have the sunset behind you, so Fourth of July [celebrations in the U.S.], skip that this year," Tong chuckled. "We'll put a flag up for you!"

HP, Sony and Toshiba have already outed their new offerings for the back-to-school season, and now Dell is stepping up to the plate with announcements of its own. First up is the XPS One 27 all-in-one. As the name would suggest, it has a 27-inch screen, and the resolution is an impressive 2560 x 1440 pixels. All configurations are going to ship with Ivy Bridge processors (Core i5 or i7) with up to 16GB of memory, and the standard 1TB 7,200RPM hard drive can be swapped out for a 2TB HDD or 32GB SSD. Meanwhile, Waves MaxxAudio 4, Infinity-branded speakers, a Blu-ray drive and optional 2GB NVIDIA GeForce GT640M GPU memory (upgradeable from integrated Intel graphics) up this machine's multimedia cred. An optional internal TV tuner will also be offered. Wrapping things up, there are four USB 3.0 sockets, two USB 2.0 ports with power charge, audio out, HDMI, VGA, mic and headphone jacks and an 8-in-1 memory card reader. The XPS One 27 starts at $1,399, and while it's available in Asia starting today, it's not expected to hit the US for a few weeks.

Original routing Dub-LHR (1.5 hour transit)-YYZ-SFO. Business class. All seats, everything confirmed.

Checked in DUB issued boarding pass DUB-LHR, but nothing else would come out of machine, so I figured I would get it in LHR (although checkin for the entire trip).

When landed in LHR, went to the AC desk, they indicated they can't give me the other boarding passes as there wasn't enough time to get to gate (over 45 min!), and just wouldn't give it go me. They rerouted me after a 10 hour delay through LHR-YYC-SFO business class. Got a couple of meal coupons but it sucked with the 10 our delay in LHR lounge waiting for the next flight.

Am I entitled to any compensation here from AC?
Sounded very fishy since it wouldn't spit out my boarding cards as well as I had over 45 min to get to the gate in LHR.? Also the earlier flight LHR-YYZ had some problem so they couldn't put me on it.

(AP) ? Former Prime Minister Tony Blair said Monday that he couldn't stand up to the Britain's media tycoons while in power, telling an official media ethics inquiry that doing so could have dragged his administration into a political quagmire.

Blair's testimony, briefly interrupted by a heckler who burst into the courtroom to call him a war criminal, shed light on the canny media strategy used to create the "New Labour" image that repackaged his party as more mainstream and business friendly, bringing it back to power after 18 years in opposition.

Blair, who was premier from 1997 to 2007, enjoyed strong press support in his early years, including backing from media mogul Rupert Murdoch's influential newspapers. But he found himself isolated near the end of his decade in power due in large part to his unpopular decision to join the U.S.-led invasion of Iraq.

The greying ex-prime minister said he long had concerns about what he once described as the "feral beasts" of the media but had to tread carefully where press barons were concerned.

"I took a strategic decision to manage these people, not confront them," he told Lord Justice Brian Leveson, who is leading the inquiry. "I didn't say that I feared them ... (but) had you decided to confront them, everything would have been pushed to the side. It would have been a huge battle with no guarantee of winning."

Leveson's inquiry was set up following revelations of phone hacking at Murdoch's News of the World tabloid, a scandal which has rocked the British establishment and raised questions about whether top politicians helped shield Murdoch ? and the media in general ? from official scrutiny.

Blair's time at the top has come under particular scrutiny because of the unlikely ? and mutually beneficial ? alliance the media-savvy prime minister forged between his left-wing Labour Party and Murdoch's News Corp. ? a company whose holdings include the populist The Sun newspaper and the right-wing Fox News network.

Blair became so friendly with Murdoch that he was chosen to be the godfather to one of Murdoch's children. The Blair government's relationship with Murdoch has since been described by several former colleagues as having been too close for comfort.

The former prime minister made no apologies for courting Murdoch, saying he was just one of several media tycoons who could make life difficult if they weren't happy with a position he was taking.

He denied doing any kind of deal with Murdoch, "either express or implied" ? although he acknowledged calling the Australian-American tycoon ahead of elections to make sure that Labour could count on News Corp.'s support.

Blair's testimony was interrupted when a heckler burst in through a secure corridor behind Leveson, shouting: "This man should be arrested for war crimes!" before being removed by security. British media reported that the heckler, who identified himself as filmmaker David Lawley Wakelin, had previously heckled Blair over the 2003 invasion of Iraq at a televised question and answer session.

Such incidents ? a testament to the divisiveness of Blair's decision to go to war in Iraq ? are routine. Last week, a handful of protesters yelling out "warmonger" interrupted his speech at Colby College in Maine.

Blair, wearing a navy suit and sporting a tan, watched impassively. Leveson, looking ruffled, said he would investigate how the man managed to sneak in to the restricted area.

Wakelin ? who was released without charge ? later told London radio that he took advantage of an unguarded door in the maze-like Royal Courts of Justice, where the inquiry is being held.

Blair spent a considerable amount of time challenging the reputation his lieutenants built up for bullying, manipulation, and "spin" in his decade in office.

Still, he acknowledged that politics and media had become "far more rude and brutal ? and in a sense crude ? in its interaction."

Blair's appearance kicked off an important week at the judge-led inquiry. Current ministers, including Culture Secretary Jeremy Hunt, Education Minister Michael Gove and Home Secretary Theresa May, are due to testify in the coming days.

Prime Minister David Cameron is also expected to testify before Leveson, whose inquiry was set up last year after it emerged that reporters at the Murdoch-owned News of the World tabloid had routinely hacked into the phones of public figure and crime victims.

The scandal has rocked Britain's establishment, leading to the arrest or resignation of dozens of journalists, media executives, political operatives and police, prison and military officials. It's also exposed a pattern of wrongdoing across the British press, from bribery to blackmail.

The investigation continues: As Blair was testifying, police said they'd arrested a 42-year-old woman who was not identified on suspicion of money laundering offenses linked to the hacking scandal. She was later released on bail.

Despite vigorously denying he gave one of his horses an illegal performance-enhancing mixture, trainer Doug O'Neill was suspended 45 days ? a ban that won't take effect until after his superstar colt, I'll Have Another, tries to win the Triple Crown.

After a nearly two-year legal battle, California racing officials agreed with O'Neill but still found fault because of a rule that says trainers are ultimately responsible for horses in their care.

The ruling Thursday doesn't prevent O'Neill from saddling his Kentucky Derby and Preakness winner in the Belmont Stakes on June 9.

The suspension and $15,000 fine ? which O'Neill can appeal ? come in the final weeks of I'll Have Another's attempt to become horse racing's 12th Triple Crown winner and first since Affirmed 34 years ago. The colt trained by O'Neill won the Derby on May 5 and took the Preakness on Saturday.

"I plan on examining and reviewing all of my options following the Belmont Stakes, but right now I plan on staying focused on preparing for and winning the Triple Crown," O'Neill said in a statement.

The seven-member California Horse Racing Board met in closed session Thursday at Betfair Hollywood Park in Inglewood, Calif., to consider the recommended decision of a hearing officer in O'Neill's case. The board agreed with the officer's recommendations on the punishment for O'Neill, who turned 44 on Thursday.

While elevated carbon dioxide is associated with "milkshaking," the officer agreed with O'Neill that his horse Argenta had not been fed a mixture of bicarbonate of soda, sugar and electrolytes that enhances performance and combats fatigue. The officer did not indicate what might have caused the overage.

"I'm gratified that the CHRB found that I did not "milkshake" a horse or engage in any intentional conduct that would result in an elevated TC02 level," O'Neill said.

The penalty comes at a time when racing is under heavy scrutiny for the way horses are prepared for their races.

O'Neill said he spent $250,000 defending himself.

"I know I didn't milkshake a horse. None of us around the barn milkshaked any horses," O'Neill said Wednesday. "You got to have rules and I respect rules, but when you get faulty science involved, it costs a lot of money unfortunately, but you've got to fight it and that's what we're doing."

O'Neill ran into trouble after Argenta tested in excess of the permitted level of TCO2 ? a Class 3 violation ? after finishing eighth in a race at Del Mar on Aug. 25, 2010. The horse is co-owned by Mark Verge, the CEO of Santa Anita race track and O'Neill's childhood friend.

But the hearing officer, who could have recommended up to a 180-day suspension, advised that 135 days be stayed as long as O'Neill doesn't have any Class 1, 2 or 3 medication violations in any state during an 18-month period.

It was O'Neill's third total carbon dioxide violation in California and fourth in his career. In 2010, he was suspended and fined for a similar offense involving one of his horses that ran in the Illinois Derby at Hawthorne Race Course in suburban Chicago.

The officer found there were no suspicious betting patterns in the 2010 race and that there was no evidence of any intentional acts on the part of O'Neill in connection with the incident.

However before the hearing, the parties had stipulated that the Ken Maddy Laboratory at UC Davis detected an excess level of TCO2 in the horse's blood sample, and CHRB Rule 1887 states a trainer is ultimately responsible for the condition of a horse, so O'Neill was punished.

CHRB executive director Kirk Breed will decide when O'Neill's suspension will begin, but it will be no sooner than July 1.

The Jockey Club has said that elevated total carbon dioxide levels, regardless of cause, are violations of the rules and penalties for excessive TCO2 are severe. It urges trainers and their veterinarians to work closely to identify any procedure or practices that may elevate such levels in horses.

ScienceDaily (May 24, 2012) ? There's nothing like a new pair of eyeglasses to bring fine details into sharp relief. For scientists who study the large molecules of life from proteins to DNA, the equivalent of new lenses have come in the form of an advanced method for analyzing data from X-ray crystallography experiments.

The findings, just published in the journal Science, could lead to new understanding of the molecules that drive processes in biology, medical diagnostics, nanotechnology and other fields.

Like dentists who use X-rays to find tooth decay, scientists use X-rays to reveal the shape and structure of DNA, proteins, minerals and other molecules.

As X-rays pass through atoms, they reflect distinctive patterns, which reveal what atoms are present and how atoms are bonded to each other. However, some data are typically discarded because of concerns over quality. In particular, data derived from edge regions of the pattern -- although very important for understanding the details of structure -- are often overwhelmed by the random errors associated with a weak signal in the midst of a lot of background noise.

Oregon State University biophysicist Andy Karplus and his colleague Kay Diederichs at the University of Konstanz in Germany have now proven that useful information can be gleaned from data that have about five times the noise level that was previously considered acceptable.

"The criteria that have been used in the past are way too conservative," said Karplus, an expert in protein structure and stability. "These data that people have been throwing out are actually good."

The bottom line for crystallographers is the accuracy of their molecular models. The better the model, the better it will predict the pattern created by X-rays passing through a molecule, and the better it will be to develop new drugs and nanotechnologies that operate at the molecular scale.

The new method may be the most important conceptual advance in the past 20 years in how these data are used in modeling, the scientists said. It shows how data from "noisy" parts of the measurement can still provide information and allows scientists to see directly where the model is limited by noise in the data and where the model is a better estimate of molecular structure than experimental data.

"The question is, 'Where do we cut it off?'" said Karplus. By adding data at incremental steps and showing how the model improved, Karplus and Diederichs showed that scientists had been cutting off their analyses too soon and discarding data that could sharpen their view of molecular structure.

"The big impact on the field will be that every structure determined from here on out will be a little more accurate because people won't throw away data that are okay," Karplus said. "If you have a crummy image of the protein, it will get a little sharper. If you have a good image of the protein, it will also get a little sharper."

While the method will be an important step for X-ray crystallographers, the scientists said that other physical sciences may also find ways to benefit from this type of data quality analysis. They noted that one branch of science has been using this type of statistical analysis for many years. The field of psychometrics -- the analysis of data from psychological tests -- has used a similar technique called the "Spearman-Brown prophecy formula" to determine the minimum length of such tests.

"Now that we know that very noisy data are useful, this will presumably enable still further improvements as it stimulates new software development to do a better job of handling such weak data," said Karplus.

(AP) ? From rare audio interviews of former slaves to recordings by Donna Summer and the Grateful Dead, 25 sounds that shaped the American cultural landscape are being inducted into the National Recording Registry.

Summer's 1977 hit "I Feel Love" is joining the Grateful Dead's famous 1977 Barton Hall concert as sounds of cultural significance, among 25 additions that are being announced Wednesday by the Library of Congress as part of its registry.

The world's largest library has chosen a diverse array of songs and sounds from history to retain for permanent preservation in the National Recording Registry. Among the new choices this year are Dolly Parton's "Coat of Many Colors," Prince's "Purple Rain" and more.

Some selections are truly historic and rarely heard. They include the only known audio of former American slaves who were interviewed in the 1930s, including one participant who had worked for Confederate President Jefferson Davis. There's also a cylinder from a talking doll created by Thomas Edison in 1888 that is the earliest known commercial sound recording. It was considered unplayable until last year, after new digital mapping tools were used to reveal its sound of a woman singing "Twinkle, Twinkle Little Star."

The library also is saving Leonard Bernstein's conducting debut with the New York Philharmonic in 1943 and "A Charlie Brown Christmas" by the Vince Guaraldi Trio from 1970, which introduced millions of people to jazz through the TV soundtrack.

"America's sound heritage is an important part of the nation's history and culture, and this year's selections reflect the diversity and creativity of the American experience," said Librarian of Congress James Billington, in announcing his final selections.

Though Summer died last week of cancer, her hit single was selected for the sound registry weeks ago, said Matt Barton, the library's curator of recorded sound. Summer had many hits, but "I Feel Love" rose to the top because it was a breakthrough that would change club music for years to come, according to the library's citation.

"From the first time you heard it, it was just, 'Wow, this is very different,'" Barton said. "We hadn't heard this before. It was enormously influential."

The registry includes early sounds from hip-hop with Sugarhill Gang's "Rapper's Delight" from 1979 that is credited with launching a genre and inspiring future artists.

Funk will have its place in the sound history collection with Parliament's "Mothership Connection" from 1975 with George Clinton's "Ain't nothin' but a party, y'all" on the title track.

Blues singer Bo Diddley is being inducted to the sound registry, too, with "Bo Diddley" and "I'm a Man."

For Mickey Hart of the Grateful Dead, Diddley's sound was some of the first beats he learned as a little boy, he told The Associated Press. So he was thrilled that sounds of the Dead were being preserved at the same time.

Hart had a hand in helping create the sound registry, pushing for a law in Congress in 2000. He said he didn't lobby for his own music to be included this year, though he was letting other "lads" in the band know about the honor.

Their music will be represented with the 1977 Barton Hall concert at Cornell University, which has been cited as one of their best performances ever. The recording was hailed for its sound quality.

"The Grateful Dead just touched a nerve, and it's still relevant in many ways today," Hart told the AP. "It's American-based music, but the combination of it, I guess, was the chemical that ignited, the energy that ignited the spirit of the people for many generations."

One key choice they made was to allow fans to record their concerts live, rather than hiring guards to take away recorders. That helped build an army of "Dead heads," Hart said, because they could all take the experience they had paid for with them. And every concert was always different.

Hart said he is impressed with his fellow inductees in the library collection.

"These are not just songs," he said. "These are talking books ? thousands of years of evolutions of cultures are in this music. It represents something even greater, the hopes, the dreams ... the joy, everything it takes to make up a people are embedded in this music."
